Help for my sons UK settlement visa! questions!!
« on: March 10, 2009, 04:29:26 PM »
Hello!
I have some questions about my sons UK settlement visa! I am finishing up putting everything together to get mailed out. I am currently applying for my fiance visa for the UK. When I send everything in can we send all our stuff in together or will he have to have a complete separate folder for all this paperwork. If that is the case how would I send original copies of bank statements, rental agreements, etc? Just send copies of the originals? It makes more sense to me just to send all our stuff in together so the ECO knows we are together and then only has to look at the supporting documents at once!

Also I have the court papers saying I have full legal and physical custody of my son with no restrictions is that enough to get his visa? Or do I need a letter from his father as well giving us permission? If this is needed this is going to be a huge problem since his father no longer plays a role in my sons life.

One more question! Since my son will be 5 in august in my letter of intent should I include our plans in enroll him in school since we will be on a settlement visa? Any help I can get would be great. I am trying to move to the UK by the beginning of April so I am sending all the paper work in a week from today! I hope that is enough time. Thank you all for any help you can give me!

I would recommend sending them together...  That way it is clear and there isn't any confusion at their end.  Your application, followed by his application followed by supporting paperwork clearly organised.

Also I have the court papers saying I have full legal and physical custody of my son with no restrictions is that enough to get his visa? Or do I need a letter from his father as well giving us permission? If this is needed this is going to be a huge problem since his father no longer plays a role in my sons life.

Should be enough if you have a clear legal document that says you have sole custody.  The only thing that is in the back of my mind is to ask the question, is the father actively serving in the US military?  Reason I ask is there are some specific federal laws that trump State laws that ensure people don't run off with kids from active military folks and it might complicate things.  I don't know the specifics, but I know it was discussed here before.  Not that it would cause issues with the ECO, but if it is the case, you should understand your legal situation.

One more question! Since my son will be 5 in august in my letter of intent should I include our plans in enroll him in school since we will be on a settlement visa?

Wouldn't necessarily help but wouldn't harm.  They are far more concerned about the ability for you and your son to support yourselves without recourse to public funds then persay his education...  :-\\\\  Generally being concise in these type of letters is better so as not to confuse or distract the ECO.

My son just turned 7.  I mailed my documents a few days ago.

When I sent the pack it had my cover letter, application (spousal) with extra photo, passport, birth certificate, then a cover letter for my son, being submitted under me (primary applicant), with his Application, birth certificate, passport and custody papers, plus a travel letter that shows his father authorizes travel (just in case), then I tabbed all of the supporting documents and included behind the applications.

We will see in a few days if that is acceptable ;P
