Applying for extension to FLR (M) instead of ILR

Hi all,

I read that "because you wife applying for an FLR instead of an ILR then she must do this within the time limits for the ILR. This means she cannot do so until 28 days before she is about to complete her 2 years probationary period. Is it true ? My wife's spouse visa expires on 20 March, she entered on 30 March. She will take Life In the UK test on 13 Feb, I understood we should apply to FLR(M) if she can't pass the exam. Is that right ?

But after reading the story above I confused about dates, should we apply before 20Feb or 2 March?

She needs to apply for ILR between 2-20 March.

Thanks for reply Larissa, if she apply for ILR without passing Life in the UK test, I think they will consider this application as FLR, in this case what happens to fee difference ?

my another confusion is : on FLR(M) form section 4.1 there is an option for applicants those completed two years but need more time to pass Life in the UK test, is it better to apply with ILR form even FLR form has got a special option for this circumstance ?

If she hasn't passed the test then she can't get ILR.  You need to use the FLR form and pay the FLR fee.

She has enough time to study, book, and probably pass the test.  It makes sense for her to do this as soon as possible, if she is staying the UK past the next two years, rather than pay for FLR now and ILR in two years time. 

If she hasn't passed the test then she needs to apply for FLR with the correct form and fee like bookgrl said.

I just passed my test this past Saturday and if she studies the proper book and takes the practice questions either in the practice test book or the ones online she will be fine. I was worried sick over mine and even though they do not tell you I am pretty sure I got a 100% and it only took me like 6-7 minutes and that was also including me going back and checking my answers.  I did study hard for about a week prior (after work each night) and took about 20 practice tests and passed them all.
11 Aug 00 - Married (Living in US)
25 Jul 08 - Spousal Visa w/ KOL Stamp Approved
01 Oct 08 - Arrived in the UK
05 Mar 09 - ILR Approved (In Person Appointment ~ Liverpool Office)

Thanks for advices, mw wife has passed the test last friday  :)
Now we are planning a holdiay before applying ILR(M) because of long waiting times without passports.

Her spouse visa expires on 20 March, we will return to UK on 15 March, will it cause a problem at the airport passport controls ?

Passport officer just remembered us her visa is expiring very soon kindly.
We have sent our application yesterday and I can see they have taken it from the PO Box (Royal Mail Tracking).
Now long waiting period started for us too.

They are really quick ! We have received her passport with ILR today.
