Unmarried Partner would like to stay longer..with PSW

Friend of mine just got PSW for 2 years visa and she met her boyfriend in London in late 2005(so their relationship over 3 years now) at that time they both held student visa but right now only my friend got PSW but her boyfriend just finished Advance Diploma and his student visa will be run out in next 2 month times from now.

My Q is : Can my friend who hold PSW visa apply for her boyfriend as dependent of her ---- in catagory unmarried partner in UK (swithing from student visa to dependent of PSW) or they have to fly back to state and apply for entry clearance as unmarried partner.

Yes, if your friend and her partner can meet the requirements for unmarried partner set forth in Chapter 13.14 of the Entry Clearance Guidance, the bit about settled excepted, then they can apply for him as a Partner under PBS. They will, amongst other things, need to show they've cohabited like a married couple for 2 years.

They would have to apply for entry clearance, and could not switch from within the UK.

They also have to have been living together for two years.
