Random Tier 1 Dependent Question
« on: April 17, 2009, 04:51:16 PM »
My fiance and I are getting married in August (we may move that up if it helps him visa-wise.) I want to apply for him as my Tier 1 dependent as soon as we are married (he is a Mexican citizen.) I noticed on the application for dependent it says to include proof of the marriage. Is this just our marriage certificate or do they want other evidence of our relationship? I tried to find more details in the guidance but must have missed it somehow.  ???

18 June 2009: Tier 1 start date
29 August 2009: Arrive in London

As with any dependent visa, it is a good idea to throw some evidence of relationship in with the application.

Ok great thank you, Vicky!  :) I'm assuming emails, pictures and bills with both of our names on them would be along the correct lines. We already live together and share bank accounts.

does this apply if everyone applied at the same time too? We included our marriage certificate, birth certificate for our daughter, and our bank statements have both of our names on them. I did not notice anything about a picture, bills, etc...

A daughter and joint bank statements sound like 'evidence of relationship' to me!

Well here's the fun part. "Technically" he lives in Mexico, but he pretty much lives with me in Brooklyn, NY.

I should add that he doesn't work in the US at all and is in the country legally even if he doesn't "live" here. He freelances all over the world, but ironically doesn't work in the US.

AudreyNYC, the purpose of my question was to establish where he might be making the dependent visa application. Clearly he can do that in Mexico City. But could he also do that in the US? I think it comes down to this. Is he a legal resident of the US, or a "mere" visitor? Looking at what you have posted, I am not sure I know the answer to that.

What you want to avoid is making the application in the US, only to be told that it is rejected because for is not a legal resident of the US.

He is definitely not a resident of the US so he will apply in Mexico City. We are thinking we may go to the courthouse in NYC to get married legally right before we go to Mexico for our wedding ceremony in August. While we're down there we'll apply-luckily our ceremony is just outside of Mexico City. Unless I'm mistaken I believed from reading that once he gets his biometrics and applies we can take the documents from Mexico City and arrange for them to be delivered to NYC on our own. If that is indeed the case we will bring them back with us to NY. I'm wondering though if they would have to send his passport back to Mexico or if we can intercept it somehow in NY. That's something I need to investigate for sure. This is what it says on Worldbridge's website that makes me think we can then take the documents and get them to NYC ourselves:

(b) Alternatively, you may make your own arrangements to send your application, passport and supporting documents either by mail to:

United States New York Processing Office
The Visa Section
British Consulate-General
845 Third Avenue
New York, NY 10022
(c) Or by an authorised courier/travel agent

I also wondered if he would need to take an English test since he's a resident of Mexico or if that only applies to the main applicant.

Main applicant only, not a dependent.

Fabulous thanks!   :D He speaks perfect English so that wasn't the worry (sometimes he uses English words I don't even know.) :o I'm just relieved that we won't have to arrange for him to take a test or anything. Hooray! Thanks for the info John.  :)
