Child with ILR
« on: January 04, 2010, 10:24:54 AM »
Just out of curiousity, I have my ILR. So if I were to have a child with my partner what would be the babys status? Even though we arent planning on getting married, would my child be a UK citizen since he is on the birth certificate? or will I have to do the whole visa process for the baby? If so,would the baby be granted a ILR immediatley? and what would be the process of making the baby a UK citizen?

If your baby is born in the UK and the dad is a British citizen (named on the birth certificate), your baby will be a British citizen from birth.

And just to add, a Child born to someone in the UK with ILR status will be a British Citizen regardless of what the other parents nationality is. See Nationality Act of 1981.

Quote
If you were born in the United Kingdom on or after 1 January 1983
If you were born in the United Kingdom on or after 1 January 1983, you are a British citizen if at the time of your birth one of your parents was:

■a British citizen; or
■legally settled in the United Kingdom.

Legally settled

Living in the United Kingdom with permission to stay here permanently (this includes indefinite leave to remain).

Someone told you incorrectly, because if her father is British and she was born in the UK, she would be British at birth. The nationality act does not state that the parents have to be married.
