Hi all,
I'm doing some initial investigation into a possible company transfer to the USA potentially for short term - 6 months or 1 year maximum.

My children and I are USCs but DW is UK citizen only (she had a greencard in 2002 but had to give it up to immigration authorities when we moved to the UK).

I've found a couple of posts lately stating that DCF is roughly 3 months which isn't too bad a wait.  My main question is, what options does DW have?  I imagine the answer could be different if I knew it was 3 months vs 1 year, for example.  AFAIK, someone can visit the USA for up to 3 months on the Visa Waiver program if she told immigration she was just visiting.  The safer option I guess is DCF and then she'd have an unconditional greencard, is that right?

Just thinking way ahead, upon receiving the unconditional greencard would it be 3 years from then to apply for citizenship or is it quicker than that?

I dont know a lot about DCF, but if have been a resident of the UK for 6 months, and have the job offer in the US, you should be able to file for your wife.  You may have more luck with one of the UK-US sites such as visajourney.com.

Oh and yes, your wife can visit the US for 6 months, but this doesnt sound like a visit to me, so IMO, she would be lying to immigration if she entered on a visitors visa.

OK, I will take a look at that website.  I guess if the stay was 6 months - year then DW couldn't come on a visitor visa for the whole time so DCF would be the other option, unless my employer sponsored her for a visa, I guess.

If she applied for a US visitor visa (B1/B2), then she could stay 6 months, but I don't know whether or not it would be granted in her circumstances (i.e. married to a US citizen, US citizen children, past green card etc.)... I have a B2 visitor visa for the US as I am not eligible for the VWP and was there in Feb for 2 weeks and for a day two weekends ago (I was in transit to and from South America) - each time, I was stamped in for 6 months.
