I did my taxes when I first moved to the UK, but not in the last 5 years. We had have 2 DSs since then, but not registered them with the US yet. It's a bit of a long story, but it's been up for discussion numerous times whether to even do so. DH is firmly against it, I'm back and forth. Anyway, neither of them have SSNs, so I'm a bit flummoxed as to how I can do the tax return with them listed as dependents with no SSN. Years ago, when DD was a baby, you could turn it in with SSN pending and it was no big deal, but I don't believe that is an option any longer. I can't imagine it will let me put the children down and list as NRA. I didn't file initially back then as I became a SAHM and wasn't earning anything anyway, so under the threshold. Now I've been thinking I really should sort this, and I wander back to this site to see terms I don't understand and a major headache.

- is there now a penalty for filing returns for years ago, even if you don't owe anything?
- do I need SSNs for our DSs in order to put them as dependents?
- if so, and we choose not to list them as dependents since I have no income and am still under the threshold, is that a problem?

Why is he against registering them? They are US citizens regardless of whether you register them or not, and it is illegal for them to go to the US without US passports, so unless you never plan to even set foot in the US again, you will need to register them and get them US passports.

Being under an intense amount of stress right now, due to a close family member being quite ill, I honestly would prefer not to be hassled over why they haven't been registered as US citizens yet. I am simply looking for some helpful advice regarding the questions I posted.

Apologies if that seems a bit abrupt, but as we have no immediate plans to go to the US in the near future, getting them passports is very low on our list of priorities right now.

You can't list the as dependents without an SSN.

I wasn't meaning to hassle you, I just got the impression that perhaps you weren't aware of the citizenship issues and were choosing not to register them under the mistaken idea (which a lot of people have) that they weren't US citizens until you did so; if I misunderstood I apologise, I was just trying to understand what the impediment was to registration, as that then impacts on being able to get them a SSN and all of that. So sorry, won't bother trying to help again.

I quite understand the whole thing with the registration. The process itself of going to London and sorting it all out with the expense and such is simply not an option for us right now, due to schedules, finances, and health issues.

I rather suspected I wasn't going to be able to file with the children as dependents without SSNs, however, I was curious as to whether or not I could file without listing them as dependents or whether I was required to put them on as dependents. I realise listing them might end up with us having some tax credits, however, my main concern is that I would like to sort the tax stuff and don't want to have to wait until after a trip to London is feasible to do so. If and when I eventually get them registered, and then subsequently put them on as dependents, I would expect they would raise eyebrows and I would probably get audited or something (as they'd be wondering where these children all of a sudden came from lol).

I was initially told years ago that if I made well under the threshold, that I didn't need to file but that I could still file to keep a paper trail, so to speak. I know briefly people were saying that DH (who is a UKC) would need to get a SSN for me to file taxes in the US, and that went over like a lead balloon with both DH and (to be honest) myself. I don't feel the US government needs all of DH's details. Don't even get me started on the whole thing about whether or not DSs will have to register for the draft or file US taxes when they are older even if they've never set foot in the US. It's a real sore point with us, and we've seen much conflicting information on it as well. The taxes hassle just seems to bring it all to the front. I think to some extent a lot of the reason I haven't filed is a combination of the confusion with the forms, the fact that I have made well under the threshold, and the whole SSN nonsense.

Your husband doesn't need a SSN, just put NRA on the form.

You may need to file FBARs and 3520s and 3520As for any Child Trust Funds - given the potential penalties for failure to file I'd swallow my pride but that is your choice.

We've never had more than $10K ever in the bank - isn't that what the FBAR is in regards to? (I am woefully ill informed on the tax stuff!!)

has anyone recently filed back taxes when they didn't owe and actually gotten a penalty?
