Driving licence query

Sorry but I suck at searches and can't find the answers and am ready to throw my lappy now  :-\\\\

My US fiance desperate for UK licence, I have gone to the DVLA website to see about getting a provisional and it says "needs to be a resident of Great Britain".

Is he technically a resident of GB now he has a Fiance visa, I always thought residency was the ILR and am confused lol

Fiance's Online application completed Wed 30th June
Biometrics taken Tues 6th July
Application rec'd at Chicago Consulate Thurs 8th July
Thurs 22nd July VISA APPROVED! W00T!
Married 15th December 2010 <3
Spouse Visa Approved 20th Jan 2011 :D

There is a difference between DVLA terminology and visa terminology. You're confusing the term 'Settled' (Holding ILR) and 'Resident'(Living in the UK). Someone can be a resident in the UK without being 'Settled'.

In DVLA terms someone is Resident in the UK once they come to live here.

He can apply for a Provisional with no problems...but he can also drive on his US license for 12 months from the day he enters the UK...so if you can find someone to insure him with his US license then he can drive before having a UK provisional.
