I-864 and DCF
« on: May 26, 2010, 10:25:48 PM »
Hi all,

i've actually posted this over at DIA as well which seems a great site but has kind of low traffic so i thought id post here too since I have done plenty of my research here too.

I've actually looked over a lot of posts and whilst I couldnt find anything that fit exactly with my circumstances, it looks as though things should work out for me and my husband.

However, being the hypercondriac that I am, Im looking for some advice from someone with a bit more experience of such matters.

Basically our situation is very simple:
I am a US citizen by birth who has been living in the united Kingdom for 2 1/2 years. I hold an ILR Visa. My husband is a UK citizen by birth. We currently live in rented accomadtion in the United Kingdom.

We have applied via DCF I-130 and are now awaiting stage 2. The only part that concerns me is the I-864 and the proof of where we are going to live.

I will not under any circumstances be travelling to the USA before or without my Husband. We will travel together with around $20,000 of savings and no other assetts. Upon arrival in the USA we intend to live with My Mother and Step-Father. My Step-Father has agreed to be a co-sponsor, he is currently earning approximately $45,000 a year and including myself and my husband would be supporting a household of 4. My Mother also has an income, but I figure she wont need to be an additional sponsor.

So I guess my main point of concern are:
- Will it matter that my own I-864 will be pretty empty and sad
- Will it be any problem for my Step-Father to be the full sponsor
- Will it be a problem that we intend to move in with my parents.

Any input and advice would be welcomed, and I apologise in advance if you've read this type of thing 100 times before.

Thanks,
Jellybean

I don't know the answer to your questions but I've been doing my own research at BritishExpats.com discussion forum. I've found it to be a great resource. Good luck to you!

To take your questions in order:

-No, not as long as you have a co-sponsor who does meet the requirements.
-No, USCIS doesn't care if your step-dad as co sponsor is supplying all of the support.
-No, it doesn't matter that you intend to live with your parents, it's just that this increases the household size your step dad will have to meet in order to reach the poverty guideline.

Hi Jellybean

Your circumstances are almost identical to mine - I'm a USC, married to a UKC, have ILR and have been living here for about 6 years. We are about to start the DCF process and I am really worried about the I-864 - however more the intent to domicile part!

The British Expats forum is a great source of advice, you should search for the post 'Nightmare in London' by Ginblossom which tells the tale of another couple's challenges with the I-864.

What proof of intent to domicile are you planning to provide? Like you, I really would like to avoid moving over more than 1-2 months before my husband but it seems like if you get a nasty CO, things with domicile can be tricky.  I am planning on sending in:

  • Transcripts of past 3 years tax returns (filed from the UK, all 0 anyway)
  • My US bank statements as I've been moving money over monthly to pay student loans for 6 years
  • A letter from our estate agent to say we have sold our flat (in the process of selling now)
  • Proof I've voted in the past 2 presidential elections by post, as well as some other state/primary elections (although I have no idea where to get this!)
  • Proof of job hunting in USA (letter from recruitment agencies)
  • Correspondence with US realtor (to set up appointments to rent)
  • Copy of my US drivers licence
  • Quotes from shippers/movers

We don't have any children so wouldn't be able to register in schools, etc.

Keep in touch to let us know how you are getting on.
