What should I do? Uk Settlement Visa question
« on: October 25, 2010, 07:11:32 AM »
Hello all,

I've been doing loads of research on applying for the UK settlement visa (spouse) and we are quite confident in our application overall at this point except for two things.

1) The convictions including traffic offenses question. Surely yes, it is best to be transparent and honest. If I do say yes though I'm not sure what to say.

I'm from Connecticut and this traffic offense would no longer be on my record. I was in an accident 4 years ago and cannot remember for the life of me what happened. It was traumatic, my car rolled over after a collision with a trucker and that's all I remember. I think I got some sort of ticket or whatever, not sure. This happened 2 weeks before I left the country for work. And since then I've moved 2x, one time to yet another country.

I seriously cannot remember if I paid a fine or just got some written thing or whatever. Would I put down: "Yes, well maybe, I think i got a ticket from an accident"

Let's be honest it makes me sound really flaky! I didn't really care at the time because I had bigger worries and everything minor comes off in 3 years where I'm from. So getting a copy of my driving history won't do much good now will it?

2) I was informed by the police back home that someone used my social security number and committed check fraud to buy a car! Not sure if he's anything else with it. :-\\\\ I contacted the FBI and was told that only stuff in connection to my fingerprints would come up. So for me that would pointless. Is there another way to find out if my identity has been connected to some other crimes or whatnot? I have no idea where he would have done stuff so local checks are out of the question.

Is there another type of criminal record? How do you get it? (Not FBI one)
Any help or advice?  :)
We met in Tokyo through friends when we both lived in Japan.

Last year we moved to Thailand, got our first apartment together, got jobs with the same employer (!), didn't end up killing each other, got married, and decided to move to the UK to settle down.

London, here we come!

Probably won't be a huge help on this one!
In terms of the traffic offences, my only suggestion would be to request your driving record, and it looks like in Connecticut you can do so online. I was in a slightly similar situation when I applied for my spousal visa (and I think a lot of people are!) I knew I had a couple of tickets, but absolutely could not remember when I'd gotten them, or even in which counties, etc., or whether or not the convictions would be spent. I got a copy of my driving record, briefly explained the one ticket that was still on it and that was that. As far as I can recall, the visa application acts about convictions which are not yet spent...someone will have to correct me on that. But I would request a copy of your driving record and send that in with your application. I don't think you have a whole lot to worry about if your only conviction is a ticket you may or may not have gotten which may or may not still be on your driving record :) I wouldn't stress out TOO much about it.
As for the fraud...Sorry but I can't be of any help there!! But the situation sounds a little vague. Do you have any more information?

Good luck and try not to worry too much!

Thanks for your reply! It makes me feel better to know I'm not alone here.  :)

So even if my record were clean (nothing on it) I should still mention the one thing I think might not be spent bc it was a fine 4 years ago? And just not mention anything else and presume them to be spent as they were like 10 years ago? What if I'm wrong?
Is there any way for them check or get my full driving history?

The check fraud thing: A guy went into a dealership to buy an Escalade. Wrote a check and used my social security number for the application. Credit check I guess.  Anyways he's guy with a rap sheet a mile long. He drove off and then canceled the check. This is what he got caught for. I wonder if there's anything he didn't get caught for but my social security number is tagged to and will affect me. I have no idea where to even begin with this! I contacted the FBI and they told me their records would be stuff with fingerprints and arrests. So that's why I wondered about other criminal; records. Obviously I don't want to contact EVERY county but what can I do?
