Easier to get marriage or fiance visa?
« on: October 31, 2010, 02:47:25 AM »
So I am looking to go over to join my SO in England. He's a UK citizen and we have a baby who has her British passport. He is coming to the US to visit in Feb, so my question is: would it be easier to apply for a fiance visa and get married in England, or get married here in the US while he is visiting and apply for a marriage visa to the UK? Is either visa easier to obtain?

Thanks!
In 900 years of time and space, I've never met anyone who wasn't important.

I am unsure about the differences in success rates for fiance versus spousal. Usually deciding which route to take is usually determined by finances. It is usually cheaper for the couple to marry in the US and to have the US half apply for a spousal visa to come to the UK. If you decide to go the fiance visa route, you'll have to apply and pay for the fiance visa. Then once you marry in the UK, you'll need to switch to FLR(M), which is another visa with more costs. And just to clarify, the spousal visa isn't a 'marriage' visa but a married one, if that makes sense. Fiance visa is intended for clearance to marry in the UK and with the later intentions of applying for FLR(M). Spousal is clearance for those already married.

So it all boils down to if you want to marry in USA or in the UK and if you want to apply for one visa or two visas.

If I'm incorrect in any of the above information, I certain one of the much more versed members of this forum will sort it out. Good luck!

another thing to consider (outside of just deciding where you want your wedding to be) is if you want to work or not.  You are not allowed to work while you are on the fiance visa.  I personally found that marrying in the States and getting my spousal visa was much easier, but there are plenty of others who really want to marry in the UK instead.

It comes down to what works for you.  I think you have to prove much of the same thing for both visas, but since you can't work on a fiance visa, they wouldn't really put much weight into things like your earning potential once you arrive when considering your ability to provide for yourselves.

For the fiance visa you need to give evidence of bookings, or at least evidence that you have started planning, and for me doing that from the US seemed such a pita.

I am unsure about the differences in success rates for finance versus spousal.

I don't think there is actually a difference as all settlement visas are lumped together into one category for visa processing times and success rates data. Whether you get a fiance or spousal visa, the success rate for US settlement visa applications is approximately 98%.

[The settlement visa category includes: spouse, civil partner, fiancé/e, proposed civil partner, or unmarried partner or same-sex partner, adopted children, family members and elderly dependent relatives.]

For me this was simply an email to the registry office where they replied that I couldn't book a date until I was in the country. Nothing more was needed.

I don't think there is a difference of ease other than if finances are a concern then with the fiance visa you have to show how you can support yourself while you can't work. Also you then need to get a spousal visa after the wedding-- so there is an extra visa in the process.
