Nasty Landlord!

My fiancee is over here on a 6 month visitor visa, I gave my landlord advance notice of her staying for a while and all seemed ok.

Today I get a nasty letter saying that I have to provide her eligibility to reside here with credit references etc for a new contract to be formed.

I don't know what to do as he is just being extremely awkward and he has also put up the rent as from 1st December.

Has anyone else had this issue? How do US visitors go on a tenancy? All I want is to be left alone and get on with my life but sadly there are too many people that like to interfere with others lives.......

US visitors don't typically go on tenancy because since they're visiting they shouldn't be renting apartments.  :-\\\\   

Perhaps just telling him that she doesn't want to be put onto the lease, but is just visiting you, make a photo copy of the stamp in her passport showing that she's able to visit the UK until X date, and show him her flight information to fly back to the US. Not sure you can do anything about the rent being increased as it's his right to do so if he's given you sufficient notice.

I came over to the UK for 6 months as a visitor.  My then boyfriend (now hubby) was in the process of looking for a new place to live as his old flat was going to be sold and he had to move out. 

He had to disclose to the letting agency that I would be living there for 6 months, but even though we explained I was only on a visitor's visa they insisted that I needed to sign the lease. 

At the time I was afraid that somehow immigration would find out and that they would think I was trying to live here permanently without the proper visa.  Someone on here who is quite expert (but she's no longer on the forum) said it would be OK to sign the lease and that there shouldn't be any negative repercussions from it.  So I signed the lease and all was OK.    (As it turns out we got engaged during that visit and I left after 6 months and returned on a fiance visa.)

Yeah, she really shouldn't be signing the tenancy.  It may not be illegal but it's not exactly kosher, as she is a visitor and shouldn't be "living" in the UK.  I don't think it's unreasonable for your landlord to ask for proof that she is a legal resident and credit references before putting her on the lease.  However, can't she just stay with you without being on the lease for the duration of her visit?  If you are engaged then presumably she will eventually be moving to the UK on a settlement visa, so she could sign the lease once she has that status.

Some leases have limits as to how long a 'visitor' can stay in the property. Ours doesn't specifically mention it, but I have had leases in the US that limit 'visitors' for periods of 2 weeks or less. Perhaps this may be the case for the OP so it would be best to check your lease and see what it says.

Thanks for the replies everyone  :)

Basically he's been a real creep and we've had to put curtains up at the property as he lives in the grounds. We live in a coach house with garages below and he seems to be always in them listening to us as some things that we have said have come out in conversation. To be honest I don't want to stay anymore but equally I want to move out in my own time.

There's nothing in my contract to state how long visitors can stay it's a simple 6 month short-hold agreement I signed back in 2007. He's a very controlling, creepy man and there's lots more I could go into but basically privacy is not something we have here at all, it really sucks!

I think I will stand my ground and get him to take action as I'm really fed up and for my part he has broken the agreement on his side bigtime, 'quiet enjoyment of the property' hmmm I think not!

Just to add to this I would highly recommend the organization Shelter.org.uk they are superb at any housing issues and will take on cases if you qualify for legal aid (not more than £733 left after rent and other calculations).

I'm hoping that my issues will be resolved soon  :)
