I-130 and I-864 need to be together?
« on: September 18, 2011, 11:46:15 AM »
I'm the USC planning on moving back to the US with my UKC husband.  We have filled out the I-130.

My question is do I need to fill out and send in the I-864 at the same time?

I don't yet have an official job proposal.   My old employer is going to hire me back.  I can get my dad to sponsor or joint sponsor if needed.

My plans are to stay in the UK until my husband's paperwork has went through so we can move back to the US together.

any advice or direction to another posting on here greatly appreciated. :)

No. You send in the I-130 with the supporting documents, then you'll receive a letter giving you permission to apply at the US embassy. At that point they'll tell you you need to start gathering the information for your I-864. You take that form with you when you go to the Embassy for your interview.

You don't have to have a job offer for the I-864, particularly if your dad is going to sponsor you. Neither my husband or I had a job offer prior to coming. We used my dad as a sponsor.

This is exactly what we did as well.

I think you might be thinking of the actual visa application. The I-130 is the petition once that is processed you receive confirmation and direction to apply for the visa like CCG said. When you file the application (DSS-230 part 1) you can file the Notification of Applicant readiness at the same time (DSS 2001) if you have all your ducks in a row,  then when you have your interview take the DSS 230 part II and then I-864's (you need one for yourself & one for your co sponsor) with you.

Here's the step by step from the US Embassy in London:
