Tier 2 visa checkground check question

Hello everybody,

I have a question which I will really appreciate if somebody can give his point of view and suggest how to act in order to apply for a Tier 2 VIsa.
It happens that few days ago I got an offer to move and work in the UK. The company will be extending the contract offer, sponsorship and a letter explaining why they need me there to fill the gap. However, while I was doing the online checkings to know which documentation I need to show to apply, I read that they will be checking for any criminal records and now I'm doubting if it could lead to a refusal.
The issues is that I got a DUI last year and a probation. I have already completed all the tasks the court ordered, I have the documentation to show that, but the case will be closed on July this year. My lawyer said that it could probably be better if I wait after July to apply for the Visa since no records will be against me after that time. But the opportunity is now and I dont know if proceed or not.
Besides this, I will be applying for this Visa from my home country but the accident happened in the US while I was doing one of my many business travels. Then, I dont know if the UKBA will be checking for records round the world or just from the place where I am from.

Any ideas or suggestions?
