Need advice before I mail my spouse visa
« on: July 24, 2012, 02:56:35 PM »
I have all the proper documents needed and have done my biometrics already so I'm looking to mail ASAP.  I am also under old rules.  American to UK

My issue has been my convictions and them being spent or not. I'm very unsure if I need to disclose certain things.
I had a DUI in 2004 and again in 09. They were 5 years apart so I THINK that the first is spent but I had a few minor ticket violations in between so I'm not sure.  The second was not in the same state so I was charged as a first time offender.

Question is - if I DO tell them everything and they ARE spent will they disregard the info? And if I DON'T tell them and they are NOT spent will they reject the app??

Any info, advise or input of any kind is totally appreciated!  Thanks!

The guidance is:
Quote
6.9 Do you have any criminal convictions in any country
(including traffic offences)?

Answer Yes/No. Please give details of the date and place (country)
of the offence and what you were convicted of. Please state what
sentence you received. You must submit, with your supporting
documents evidence of the conviction (e.g. the official record)
detailing the crime you were convicted of and the sentence you
received.

The guidance for the visa does not mention leaving off spent convictions, so you need to claim them on the app.

It would be best for you to disclose everything- if you hide an unspent conviction from them and the UKBA find out, in some cases they will ban you from entering the UK for 10 years.

I was afraid of that. That's why I said " see attached documents" on the online app. I don't have any documents from the first.  I do have a certified copy of my driving record that I just got today. I can't make heads or tails of it though!  Bad decisions are coming back to bite me in the @$$...
