UK bank account and funding for spouse in USA
« on: April 20, 2013, 12:31:17 PM »
Hi there, I didn't know what else to title this so I hope this gets some views. My husband and I are planning on moving back home to the states ( I am USC ) (see post by us in Repatriation with our background)

Just another question. We will be selling our house to gain the equity as well as our beloved VW camper and other belongings to get the %125 of the poverty line ( about $30,000).

Will we need to then transfer funds to an American bank-account or will they accept a statement from a UK bank account?

Do we use the same form? ( I-864 )

We don't want to wait until I get a job over there ( I am a qualified Nurse ) to fill out his forms and as we just had twins I don't think my husband could let us move over for a while to get the funds/settle in the job and then apply for him to come over as I hear the whole process takes about 10 months etc.

Any further advice on this matter will be very very appreciated!!!

Thanks,
 :D

Hi there! Yes you use the same form I864. We used our UK bank account, although that was 5 years ago.
I don't know how much you plan on having from the sale of your home, but I just wanted to point out that you will need MORE than the $29,437 for a family of 4 if you are using assets to qualify on the I864. Whatever your income that you use for the I864, if it falls short of the guidelines you need 5x the amount you are short in assets to qualify.
Example, if you make $25,000  you would be short $4,437 and would need 5x that to qualify on your own. So in addition to your income from your job, you would need $22,185.00. It sounds like you plan on all going over together and you won't have a job, so I would think you would need $147,185(29,437x5)

Someone can correct me if I'm wrong, but I'm pretty sure I'm reading it correctly. If you need more in depth help, as this site is mostly for people emigrating to the UK, I suggest looking at http://www.visajourney.com/ as they have a forum dedicated to DCF and a whole subforum for the UK. You'll get some help from the lovely here at UKY, but Visa Journey has tons of helpful info for US immigration.

It's actually three times the poverty guideline, not five.

Quote

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guideline and actual household income.

You also don't have to sell your house to count it as an asset.

Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?

Yes, under the following conditions:

The assets must be convertible to cash within 12 months
The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country
The net value of assets is at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size.

Sorry, I was looking at the directions for a parent or other relative...not a spouse.
