Questions on Spouse Visa application

Hello

So, on the visa application there are a couple of questions that I am unsure how to answer.

They ask if you've ever worked for a security company, private or state. I have, but I do not remember the exact dates. I'm concerned that if I answer incorrectly they would see me as trying to falsify information.

Also, they ask if you've ever received medical treatment. While in the UK last year I visited a local clinic because I had strep throat. I've gotten it fairly regularly all my life. The doctor wrote me a prescription for antibiotics, which I paid about £8 for. Is this considered medical treatment? I did not pay for my visit to the doctor - I tried but they would not charge me anything. The doctor did not do anything other than write the Rx. I'm inclined to disclose it, but will it be an issue? Did I break the rules?

June 6 2013 - Received "A decision has been made..." email with UPS tracking details
June 10 2013 - Visa Issued and received via UPS!

Hi

Explain what you do know about the security company. If you can't remember the dates but know approximately then say so but say approximate.

It's best to disclose the visit to the doctor and explain it. It sounds like it was using the NHS which could potentially be an issue but you did try to pay so explain that too.

No, but you were supposed to pay for the appointment and you may have been supposed to pay more than £8 for the prescription because you were not entitled to pay NHS charges for it.

Even though they told you not to pay, they are not usually aware that some people do have to pay and are not entitled to free treatment (they may not have actually had a means to give you a bill as they don't usually deal with paying patients), so really you should have pushed it and insisted they bill you, even if it meant going through the management offices.

They should not refuse the visa unless you have more than £1,000 in outstanding NHS charges though, so it shouldn't be an issue (as one appointment would not have cost that much), but you ought to explain that you tried to pay for the appointment and they would not give you a bill.

Is there some way that I could obtain a record of this visit? Does the doctors office keep this kind of information on file? Could the UKBA obtain it somehow on their own?

I'm not sure how much they check during the visa application process, but if you chose to not disclose it now and it came up later, it could be seen as deception and could cause problems down the road, if not now.   :-\\\\  Best to explain it as best you can, I think.  :)

Someone else on here had the same thing- the GP wouldn't let her pay.  I think she got a note from the office confirming they had no way to charge her, but I can't remember what happened with her situation.....  ???  I know that doesn't really help you now, but others have been in your shoes.... hopefully one of them can tell you what they did.  :)

I've been fine up until now thinking about submitting my application. But now I'm so scared that the ECO will think the worst of me. I have an old DUI from 2006. Went through a red light in 2011 by mistake. I used NHS as a visitor though I tried to pay. And my partner and I entered a civil partnership on a visit visa. I'm worried now about other things I haven't thought of in years - parking tickets hiding in my past that I maybe forgot to pay or something?

Am I worrying unnecessarily?

My partner did say that she would get in touch with the clinic I went to and tell them the situation and see if they would give us a bill to pay that I could submit with the application.

I'm supposed to be applying in just a couple of weeks and I feel scared to now.

No it's not.

The only criminal conviction you have is the DUI and that was spent in 2011. Plus you can use Worldbridge if you have unspent convictions but it just might take a bit longer to process.

Don't worry about the NHS stuff or marrying as a visitor as neither should be a problem for the visa. Just explain about trying to pay for the NHS appointment.

All in all:

- they can't refuse the visa because of convictions because the red light is not a criminal conviction and your DUI is spent.

- they can't refuse the visa because of the NHS stuff because you don't have more than £1,000 in NHS debt.

- they can't refuse the visa because you married in the UK as a visitor because you didn't actually do anything wrong. It's not illegal to marry as a visitor without a visa but you're just not really supposed to do it (if you knew you were going to marry before you came to the UK, you should have got a visa first, but if it was a last-minute decision while you were here, then that can't really be helped). At the end of the day, as long as you are legally married that's all that matters.

In short, I don't think you really have anything to worry about :).

P.S. The ECO probably won't think anything of you. As long as your documents meet all the requirements, the visa will be granted. Remember that approx 98% of all spousal visa applications lodged in the US are approved.
