Topic: Spouse Visa, No Biometric Residence Permit - proof of right to work?  (Read 1628 times)

Hi guys,

I am new to this forum having just received my spouse visa from outside the UK (what a relief!) I hope I am posting in the right category, as this is more commencing work related than visa related!

As I am already beginning to seek employment for my move in a few weeks, I was concerned that nowhere on my visa does it explicitly state I have the right to work. After going through the UKBA's website on helping employers check right of employment documents I see I need to provide one of these:

The person must be able to show that they, or a named person (eg a family member) on their passport, has one of these:

biometric residence permit
registration certificate
document or letter from the Home Office indicating indefinite leave to remain in the UK


I don't have a BRP as I didn't apply from inside the UK, and I obviously wouldn't have a letter saying I have indefinite leave. After clicking on "registration certificate" I see residence cards are lined up next to it, which is the sticker in my passport. Will this be sufficient for most employers? Has anyone else without a biometric residence permit had any problems with just their spouse visa?

Until recently no one had BRPs, and still no one who applies from outside the UK gets them.  So yes, people get jobs with just the spouse visa all the time.  It's perfectly valid and acceptable as right to work. 

Just FYI, visas that prohibit work say "no work".  So if your visa doesn't mention it that means there's no restriction.
