IRA to Roth transfers for a non-domiciled resident?
« on: January 24, 2013, 08:50:34 AM »
Hi,

There are posts about this, but over 6 years old, and the laws I think, have changed.

How are transfers from pre-tax IRAs to Roth IRAs dealt with in the UK for a non-domiciled UK resident?

Many thanks,
MidAtlantian

If you are taxed on a remittance basis there are non UK tax consequences. If you are taxed on an arising basis UK income tax would have to be paid on the rollover.

Hi,

  Thanks for your response.

If it is on an arising basis, but the tax was paid
to the US, does one get credit for having paid it,
even if it was due to the UK?

Cheers,

Strictly speaking you should be paying the UK first and using the UK tax paid as a credit against US tax, but you can try to get a UK credit for the US tax you paid and see what HMRC says.
