Co-sponsorship for uk spouse for usa move?
« on: February 20, 2013, 09:38:04 PM »
Hello!
I had a look on the US gov site but I got confused... Is there a specific form that is filled out by the USA co-sponsor who sponsors a UK spouse of a US citizen, for the US citizen, if they plan to move back to the USA together?

A sort of 'Third Party Support Agreement' form, I guess?

If so, can someone please post a link for me?

This is for a friend I have been trying to help, not for me, and I know nothing about returning to the USA! Her potential co-sponsor wants to know exactly what they are signing up for. (Can't blame them!)

Many thanks!!!
L.

Married 04/13/11, in NYC.
Applied for Spouse Visa the following week, with express service, and I was approved 4 days later!
Arrived in the UK 05/20/11.
I took the stupid LIUK Test Oct. 2012.
We were granted ILR In Person in Croydon on 04/23/13.
Got BRP 2 days later, in mail box - it just appeared.

The sponsor -- which, like the UK, must be the spouse. They fill out the I-864.

The co-sponsor can be anyone. They also fill out the I-864. If that person has a spouse *and* is using that spouse's income to meet the poverty guidelines, the spouse fills out the I-864A.

The basic summary of the agreement is that the co-sponsor agrees to support the immigrant; should the immigrant fall on hard times and claim benefits, the co-sponsor is liable to pay those benefits back. The agreement lasts 10 years OR 40 quarters of work OR until the immigrant naturalizes.

So if the sponsor has not yet had an offer of work in the US, and the couple does not have savings, then the co-sponsor is used?  Quick question then without me trying to find a form I-864. Obviously it looks at the co-sponsor's income, so I guess maybe recent tax forms? And what about any other assets?  Since we will likely be co-sponsoring our daughter's husband (after their upcoming marriage in a few months), I'm starting to think aout what information we will need to have at hand to help with the process. Thanks!

That's right -- if the sponsor has no savings, assets or work, then you need a co-sponsor.

The I-864 requires your three most recent years of tax returns -- if you meet the poverty guidelines by income alone, then nothing further is needed; for example, my parents have assets but when sponsoring my husband they didn't need to disclose them since income alone was enough to meet the requirements.

Is there any requirements that the co-sponsor live in the same State as the sponsored person intends to live in? I see nothing out there to make me think this but thought I should double check.... thanks all  :D
