Hi Everyone,

I'm a US citizen, found this website when looking for info on applying for my spousal visa and found it so very useful. Hoping it can help me again now that I'm in the UK!

I moved over here July 2012 on a spousal visa and began working in October. I also worked in the US for the first half of 2012. I am filing taxes for my US earned income and foreign income in the same tax year. I haven't been here for the 330 days needed to get the exclusion so I'm not sure what my next steps are. Am I correct in thinking that I can file for an extension using form 4868 until I reach my 330 days? Do days in 2013 count towards the 330 days?

Any help would be very much appreciated!

You have a couple of choices - file an extension and file after you qualify for the exclusion (yes, days in 2013 count) or do the math and see if you are better off using the foreign tax credit.

If you think you will owe US tax under either scenario for 2012 you should have paid by the regular due date (April 15); any tax due now accrues interest.

1st move to UK - 1993 (Letter of Consent granted at British Embassy in Washington DC)
ILR - 1994 (1 year later - no fee way back then!)
Back to US in 2000
Returned to UK July 2011 (Spousal Visa/KOL endorsement)
ILR - September 2011
Application for naturalization submitted July 2014
Approval received 15-10-14; ceremony scheduled for 10 November!
Passport arrived 25 November 2014. Finally done!
