Villagers fight to save local hero teacher from being deported
An attempt to send a respected headteacher back to the US has raised hackles in Scotland

:( At least he's getting the support of a national newspaper. But really, 10 months to make an ILR decision? Really?
August 2008 - Tier 4 - Student Visa
February 2010 - Tier 1 - PSW
January 2012 - FLR(M)
June 2014 - ILR (finally!)

The article is a bit heavy on the melodrama and light on the details of the refusal.  :-\\\\

Sounds like he applied for ILR based on marriage to a UKC but was actually on a Tier 2.

While my background in the profession assures me that this blip was just inserted into the denial letter as an initial defense in an Article 8 appeal, I still find it heartless and unnecessary:

 "English is the first language of both you and your partner; therefore language is not considered to be an insurmountable obstacle to your partner accompanying you to the United States."

I would really like to know what the facts are in this case.  ???

The article itself is very discouraging for someone like me who is looking to move to the UK because I'm in love with a UKC, and all I can bring is myself and enough resources to ensure I never become a burden on public funds!   :(

My only talent seems to be a rather impressive knack for snarky comments.  I'm still trying to figure out how to get paid for that one. ::)

Now though, it believes it is a sham marriage, saying: "It is not accepted that the evidence you have provided is sufficient to confirm that there is a genuine and subsisting relationship between you and your sponsor [his spouse]."  It still sounds like the complete story hasn't been told.

I'd say 'offer your services to the Grauniad' but they seem to have plenty of people willing to do that for free....

I also would like more facts.  The 'pining for the Hebrides' angle is all very well, but the bits of information they provide don't clarify anything.

As people always say on the visas board: post the exact text of your refusal letter.  :)

I don't know if anyone is still following this, but it turns out he did apply for the wrong type of visa.  Should have used the visa board! ;)
