New Net Investment Income Tax

The US has a new tax in investment income. It's the Net Investment Income Tax. The MAGI thresholds for it to be applied are large, $200k for a single filer. But I'm interested if it would apply to gains on UK retirement accounts that are currently excluded from US tax under the US/UK tax treaty. I have read that it's classed as an excise tax which are not covered in the treaty.

Current conversation is the tax can not be offset by FTC's. I have no idea if this is correct.
