some questions regarding FLRm application
« on: February 01, 2014, 05:56:38 PM »
Hi!

I feel like this is a stupid question, but I am about to apply for FLRm as a partner of a UK citizen (got married yesterday! :) ). I came into the country in 2008 on a student visa, had a post-study work visa for 2 years and for the last 2 years have had a Tier 2 sponsored visa.

On section 5 - immigration history, what do I put for the date I entered the UK? The last time I entered after coming back from holiday last summer or the very first entry to the UK in 2008? I'm guessing the former with my Tier 2 visa listed but I want to be sure...

Also, I am planning on including as supporting evidence of our relationship:
- screen shots from the last 2 years of emails
- handwritten letters from when we were first dating (can I include copies, or do I have to include the originals?)
- 5 photos of us together over the course of our relationship
- marriage certificate
- email of the confirmation of our booking from our holiday last summer
- bank statements from both of us sharing the same address

Should that be OK? Thanks!

Congratulations!

Use the date of entry on your first visa.

You really only need your marriage certificate.  You can include a photo from the wedding if you want.  None of then other information is needed and won't be looked at.

It's the date you first moved to the UK to live. So, you put the date you entered the UK on your student visa in 2008.

If you have been living together in the UK, you don't need to send much at all for relationship because you see each other every day.

You only need to send:

- your marriage certificate
- 1 or 2 photos of you together (maybe your wedding day and one other photo from your relationship)

You will presumably be sending your bank statements to meet the financial requirement, so they will see from those that you live at the same address.

You don't need to include things like emails or letters to each other, because you live together in the UK already. The emails and letters are only needed to prove regular contact if you can't see each other in person and have been living in different countries... it's to prove that you are not in a sham marriage and that you are not just using your spouse to get a visa to move to the UK. You already have permission to live in the UK without being married to a UK citizen, so this doesn't really apply to you.

Actually I have two more questions... sorry, more little things keep popping up! I make over the £18,600 needed on my own and so am only sending in my payslips from the last 6 months - will that suffice for the requirement?

Also, do I have to have a full copy of my husband's passport certified? He needs his passport to travel for work.

Thank you!

That's fine. Because you already have permission to work in the UK, you can use your income to meet the requirement.

Remember to send in all the other documents required as well:
- Letter from your employer
- Matching bank statements for those 6 months
- your job contract
- your most recent P60

No, you don't. It says in the FLR(M) guidance notes that you can now just send a regular photocopy of his passport (not certified), but you must photocopy every single page of the passport.

Great, thank you.

I swear this is my final question now:

When filling in the form, I put permanent under the type of work, but it is a fixed-term contract (I'm an academic, my contract is Aug 1 - July 30 yearly). I've been at the salary I am relying on for financial requirement since Aug 1 2012 but I have worked for the same company since Sept 30 2009. I put the date my employment began as Aug 1 2012 - was this correct to do? I can include both 2012-13 and 2013-14 contracts in my application.

Thanks!!

Sorry, didn't see your question until now.

If you've been working in the same job role/title since Sept 30 2009, then I would put that date; but if your current employment is a different job role than you started out in, then I would put the Aug 1 2012 date (i.e. if you changed job titles, rather than just getting an increase in salary for the same job title).

Ultimately, it's not going to make a whole lot of difference because you only need to provide the last 6 months of payslips and bank statements to show the salary earned. If you want to include both employment contracts, that may help to show that although the contracts are fixed-term, they are being renewed each year, along with the employer letter.
