When should I enter the UK with Spouse Visa?
« on: January 31, 2014, 03:37:50 PM »
My visa was granted with an approval date of January 22, 2014. I am wrapping up life in the USA now and plan to work for 2 more months. Do I have 3' months and under' to depart or is the timeframe 'still 3 months plus 28 days' to meet the ILR terms?! I believe the rules have changed and I would still need to apply for FLM regardless. I may not be able to enter until April 29, which is ONE WEEK past the 3 months.  :o
Met: October 2011 (many trips back & forth)
Married in Salem, MA, USA:  August 2012
Filed spouse settlement visa online: December 31, 2013
Biometrics: January 7, 2014
FedExed documents to Sheffield: January 17, 2014 (did NOT pay for priority service)
Received in UK: January 21, 2014
Decision has been made email: January 24, 2014
Visa in hand: January 28, 2014
FLIGHT TO UK BOOKED FOR APRIL 1, 2014!!!!!!!

It's 3 months and 28 days - so you would be fine to enter on April 29th.

Even though you have to apply for FLR(M) next, before ILR, you might still need to enter within 3 months and 28 days in order to qualify for ILR after the FLR(M).

If you leave it more than 3 months and 28 days, then your next FLR(M) visa may expire before you have been in the UK for the required 5 years for ILR... so you would need to pay for a second FLR(M) to meet the requirement and then ILR.

If your visa start date is January 22nd, then you have until May 20th 2014 to enter on your visa and still be fine for ILR at the end of your FLR(M) visa.

Of course it still depends on things like the processing time for your FLR(M) and how they work out the 5-year requirement (i.e. if it takes a few months to get FLR(M), then when does the 5 years finish?), but to be safe, I would still try to enter by May 20th.
