Category A Financial Query (Calculations and Sick Pay?)
« on: January 31, 2014, 09:12:20 PM »
I have recently started a new job on the 6th January 2014 originally at £18,600 a year, although this has now been increased to £19,400 a year and is to be backdated for the month of January.

My intentions were to work in this position for 6 months (and collect the 6 payslips) before applying for my partners spouse visa in July ( using Jan - June)

However, because I did not start work until the 6th January, my first payslip is for only £1300. My February payslip will be over the £1550 amount (as it will include the pay rise and also the backdated pay rise that I did not recieve in January.

My question is, can we apply after the 6th July (being my 6 month anniversary in the job) using Jan through Junes payslips, along with the contract from the employer showing my annual salary as £19,400 and if needed a letter stating that this was backdated for January and thus why the January payslip is less than expected?

Or would we have no chance as they would take that lowest payslip from January and times it by 12, even though a contract had been supplied showing I earn over the annual income requirement.

My second question is in regards to sick pay. I am having to take two weeks sick pay in February for surgery, and am concerned that this will cause a problem for the visa application. I will be paid sick pay whilst away so my actual income on my payslip will still be the same, although it will show up as sick pay. I am concerned because I may have read somewhere that sick pay does not count as income in regards to meeting the financial requirement.

We are just trying to calculate when we can apply, as in July, I will have been employed for 6 months and have the contract showing the annual salary, but my first payslip will be low (as mentioned) and my second payslip will have the sick pay on it. I'm really hoping that we don't have to wait to apply until September just because we can't use those two payslips?

Any help greatly appreciated as I got a headache trying to find the answers in the Appendix on the UKBA website......

They will take the lowest payslip amount, so you will have to wait until you have 6 months of payslips showing £1,550 or more. If even just one payslip drops below £1,550, you won't qualify for the visa.

Your sick pay is irrelevant. All that matters is that the amount on your payslip is £1,550 or more before tax.

Thanks so much, I kind of thought that was going to be the case, it just seems so ridiculous though, because my contract will clearly show I earn over the required amount and am on  a permanent contract.

Glad to hear the sick pay won't be a problem, I probably read it somewhere incorrectly.

In the grand scheme of things, waiting to apply for an extra month to be sure that there are no problems is not such a big deal - heck after all this time apart, what's another month! I'm just so appreciative of the fact that I was able to get a solid job that meets the requirements!

So we will apply in August using my Feb to July payslips which will all be over £1550 each.

Can I ask if anyone has had problems getting their bank statements? I've discovered today that my bank statements run from something like the 15th of every month to the 14th of the next.........does that mean for instance, when I get my July payslip (on the last day of July) I am going to have to wait until after August 15th to get the corresponding bank statement to show that money going into my bank account to apply? Or have other people had experiences of going into the bank and asking them to provide a statement from the 1st of each month til the last day of each month (because all I will need is to prove the money is going into my bank with the corresponding statement) Hope that makes sense.

Again, hate the idea of having to wait any longer than we have to, since as soon as we are married I am leaving my husband behind for however long it takes for all this process to go through :-(

Appreciating all the help, and after I've been through the process and got the hang of it, will return the favour by the millions!

It's probably worth asking if they can provide you with a statement covering the most recent few weeks before you apply (with your latest pay on it), so that even if you don't have your regular monthly statement, you may be able to show a mid-month type statement. Alternatively, they may be able to provide a letter with the information - you would have to see what they are willing to provide for you.

Thanks KSand.

We are applying for the marriage visit visa any day now, so am going to pop to the bank today and use it as a trial run - see what they say about the statements or a letter of confirmation.

Will report back how it goes incase anyone else is having the same question.

Some interesting days ahead, but today is officially the day it all starts. Day 1 of my 6 months ........

Just thought I would report back about the bank.

I bank with both Barclays and Nationwide, both of whom could give me a standard printout (not on headed paper) of my incomings and outgoings from whatever dated I wanted and they were both happy to use the bank stamp on them.

They also both said that if I wanted something more official, on headed paper, if I phoned up in advance they could order them from their Head Offices and have them posted out.

So should be easy to get some midway statements from them like that.
