US mil-spouse working in UK
« on: February 04, 2014, 07:31:23 AM »
Hello,
I'm sure this has been discussed before, but I can't seem to find anything on this subject.
I'm an American mil-spouse living in the UK with my husband who is stationed here. I work for the local County Council as a social worker.
Do I file taxes in the UK or US or both?  ??? ??? ???

Any help or advise would be greatly appreciated!!! Thanks!

US tax return must be filed ....always....and all income declared regardless of where it was earned. You can a claim credit for tax paid to the UK or the earned income exclusion if you qualify. That's the simple answer. Specifics of which forms etc. depend on your situation.

If you are on PAYE (which you probably are), you may not need to file a self-assessment in the UK. Depends on your circumstances and other income (if any).
Married December 1992 (my 'old flame' whom I first met in the mid-70s)
1st move to UK - 1993 (Letter of Consent granted at British Embassy in Washington DC)
ILR - 1994 (1 year later - no fee way back then!)
Back to US in 2000
Returned to UK July 2011 (Spousal Visa/KOL endorsement)
ILR - September 2011
Application for naturalization submitted July 2014
Approval received 15-10-14; ceremony scheduled for 10 November!
Passport arrived 25 November 2014. Finally done!

Hi :D

Vadio is right, the US return must be filed no matter what.

As far as your UK return is concerned, generally the UK will consider you a resident for tax purposes if you have been in the country for more than 183 days. If this is the case, you can expect to file a UK return as well (fortunately with the tax treaty in place it is unlikely that you will see any double taxation).

More information on whether or not a UK return is necessary can be found here: http://www.hmrc.gov.uk/international/residence.htm

Hope this helps!

Your husband is presumably covered under SOFA (the Status of Forces Agreement).

You may well not be within self-assessment at all (as our systems are different; here in the UK only about 9 million personal tax returns are filed each year; compared to 150 million in the US).
