First, I'm happy to hear that you're feeling better.  Moving to a foreign country is obviously going to be a big adjustment, and it can definitely be a roller coaster, especially with an illness.  Hang in there, we're all rooting for you!

I am applying for my NINO and am looking to find a job...anykind at this point just to get me out of the house and let me live a little bit. I have been doing the stay at home mom for almost 4 years now, and I think it's time. I have a Master's Degree from the States, so hopefully luck will strike me.   8)

This, however makes a few warning bells go off in my head.  As you are a visitor in the UK, you are not allowed to work (even volunteering as a visitor is prohibited).  I therefore recommend that you sort out your immigration status in the UK if want to have the options of working and staying longer term. 

As the spouse of an EU citizen, I believe you would have to apply for an EEA Family Permit, and there are a few threads floating around here on UKY if you do a search.  I only mention this, as it may be a quicker route than obtaining Romanian citizenship/applying for a passport. (Unless you already have citizenship, of course-- it looks to me like they base citizenship on your  parents' citizenship rather than just your place of birth, and I'm not sure of your full situation)

Pickled, I probably did not make myself clear. I am a Romanian citizen also, by birth. I have dual citizenship. Romanian/US. And I have a Romanian passport, which also makes me an EU member and allows me to work. Sorry if I wasn't specific enough.

I thought you didn't have your Romanian passport yet?

In your post from March 21st, which was only 2 weeks ago, you said that you were eligible to apply for a Romanian passport and were considering doing it, but that you didn't have one yet and were on a tourist visa in the UK using your US passport.

Have you applied for and received it in the last 2 weeks then?

I would have thought it would take a lot longer than that to apply for and receive a first Romanian passport, not to mention that you might have to actually go to Romania to apply for it (I don't know the rules for applying for a Romanian passport though).

It's not my first one. I had one when I came to the US in 95 and that expired in 2000. I just had to get it renewed. I got it through the Romanian Embassy here in London. Paid for priority, and got it in 3 days. If it's your first one it does take about 4 weeks.

Oh good, ok.  Doesn't seem like there would be any worries then, as Romanians are (as of Jan 2014) now free to work in the UK without the need for a work permit.  I assume you'd probably want/need to sort your child's passport also, if you've not done so already.

Thanks. That is my question. What do I do about my child's passport? He is obviously only a US citizen, and only has a US passport. His visa expires the same day mine will, June 16th. What do I do about it? Since he has EU parents, he does have the right to stay here, correct? Please help out if you know any info.

He is not only a US citizen, he is a Romanian citizen as well, and has been since the day he was born. You will need to get him his first Romanian passport in order to continue to live in the UK.

Neither of you actually needed a visitor visa for the UK at all - you could have sorted out your Romanian passports before coming to the UK and entered on them in the first place, thereby skipping the 6-month visitor visa and being entitled to live and work in the UK from the day you arrived.

Which says:

Art. 5. – The children born from Romanian citizens on Romanian territory are Romanian citizens.

Furthermore, Romanian citizens are also those:

a) born on the Romanian territory, even if only one of the parents is a Romanian citizen;

b) born abroad and both parents, or only one of them has a Romanian citizenship.

The child found on Romanian territory is a Romanian citizen if none of the parents is known.

Thank you so much. I guess we will have to go to Romania ASAP to get him his passport then. I thought since he was a minor, he wouldn't need it. So we have to go before June 15th! I guess we learn something new everyday, thanks!

There should be a Romanian embassy in London that you can sort out the baby's passport, right? If anyone has more information...

10/05/09--Leave for the UK!!!
06/15/12--Back in the US indefinitely...

There is, because the OP said she just renewed her Romanian passport through the Romanian embassy in London.

However, I'm not sure if it's that simple for a first passport...I believe the child will need to travel to Romania to apply for it.
