Put house under my wife's name?
« on: May 05, 2015, 01:38:43 PM »
Put this under the house section first....thought it would better here.

We are in the process of buying a house. Just wondering if in the long term it might be beneficial to put the house in my wife's (UK) name. At some point in the future I was thinking about taking my wife off my US taxes.....at least if that would be monetarily smarter.

This is standard planning to avoid US income tax on future gain on sale, on foreign currency gains and in estate planning.

How would that work on demise of UK spouse?  What would position of US spouse be then?

While I do not consider myself even a little bit qualified to answer this... here goes!

Our house is in my husband's name only.  His will leaves everything to me in the event of his death.  Our solicitor said that it doesn't matter that my name is not on the house.

That's what we plan. We still need to update our wills from the US.....but that will likely have to wait a little while until the house buying is done.

But now we were just sitting here talking about this again.....are there any downsides to only having my wife's name on the paperwork? We need to get both names on utilities etc so we both can build up our credit scores etc. I am just in the act of buying a Samsung S5 phone but couldn't go through carphonewarehouse for EE since we haven't been here the last few years. O2 is luckily not so picky and they said I could get  some kind of a contract through them. Obviously I need a decent paperwork trail since I will have to apply for another visa in 29 months or so.......

The house you pass to the spouse.....no inheritance tax issues. It would be important to make sure all the paperwork like changing the name on the title got done as that is sometimes missed.
