FLRM Application - Stuck on form

Hi everyone,

I'm a newbie and I apologise if this is a long post. We are preparing my husband's FLRM application which we are hoping to post next weekend. I am stuck on a few questions and would really really appreciate some help.

QUESTIONS

2.2 Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave granted as a fiancé(e) or proposed civil partner) with your current sponsor?
-------My husband came here on a spouse visa, so do we answer YES or NO?


2.3 Please indicate what stage of extension of leave you are applying for or why you are choosing to extend your current leave in one of the above categories.
--First period of leave to remain (following an initial period of entry clearance as a partner of a settled person, or following an initial period of entry clearance as a fiancé(e) or proposed civil partner of a settled person - 6 months)
--Second period of leave to remain (following initial grant of leave to remain).
You are making a first application from within the UK but have not previously had leave to enter/remain as a partner.
--First period of leave to remain (following an initial period of entry clearance as a partner of a settled person, or following an initial period of entry clearance as a fiancé(e) or proposed civil partner of a settled person 6 months)
--Second period of leave to remain (following initial grant of leave to remain).
--You are making a first application from within the UK but have not previously had leave to enter/remain as a partner.
--------(Again, I'm not sure about this one - my husband was given a spouse visa which he now has to extend - he's here on the five year route)


8.4 Have you passed an acceptable English language test provided by a test provider approved by the Home Office for this purpose?
---- My husband passed the Pearson test for English in 2012 and it was valid till June 2014. I have been reading Appendix FM section 2.1 - 2.2.2 over and over but I am confused as to whether his test is still valid? Section 2.2.2 states tests taken on or after April 2013 are still valid. But then I have also read that this rule doesn't come into action until November this year? So I really don't know if my husband has a valid test that we can submit or not?

My main concern is question 8.4 as I'm worried his test is not valid?
Would anyone be so kind to help?

You answer NO.

It's not his first visa in the category you have just ticked (which should be the first box in the list). His first visa was the spousal visa and the second visa will be the FLR(M).

You answer YES.

This is his first period of leave to remain in the UK (FLR(M)), following his initial period of entry clearance as a partner of a settled person (his spousal visa)

I'm afraid I can't help with 8.4 as the forum mainly caters for US to UK immigration where the applicants aren't usually required to take an English Language test for the visa (since their US passport is all they need to show).
