Speeding ticket clarification
« on: January 07, 2016, 06:05:18 PM »
Hi there, I've read lots of conflicting evidence and advice re this but looked at the guidance notes for spousal visa application and noticed it says:

You must give details of all spent and unspent convictions. This includes traffic offences but not fixed penalty notices (such as speeding and parking fines)

So this means my US partner doesn't need to disclose any speeding fines?? He hasnt had any for years anyway but I've read so many posts from
People having to drag up evidence from different states etc and people saying to disclose everything. Which is right??

Just wanting clarification. Thanks so much

The general consensus here on the forum is to disclose everything, just to show you are telling the truth... and also just in case you have something on your record that you think is spent and won't matter, but it turns out that's not the case - if you don't declare it and then it turns out you should have, they could think you were trying to hide it. If you do declare it when you didn't need to, then it won't make a difference to the application anyway, and it shows you're an honest person.

Thank you for your swift reply as always. You really are a star!

We were planning to disclose everything (indeed he is getting his dmv record pulled as I type) but thought it best to not put on speeding ones as they specifically tell you not to? I suppose as it won't affect anything it's better to just disclose everything as you say. I just don't want it to look like a list of stuff as he has a spray painting charge from being a teenager and an ordnance violation with fine from 8 years ago. I'm hoping all will be ok!! He's getting his entire criminal record via his finger prints so hopefully that will show up everything (he thinks he may have got a ticket for driving on a suspended licence when he was 20 too but can't remember exact details as hes nearly 40!) I am cursing his reckless boy racer young self :( Hoping it doesn't cost us our visa!

Thank you for your help. I know we've discussed this before a while back.

Me again. He's just text to say the DMV report showed 2 things from 2000 when he was 21. These were driving on a suspended licence and driving carelessly. These are both 16 years old now. Will he have to provide court documents for them?? I'm not sure if he'll be able to get them. Would the dmv document and an explanation be enough??? Thanks so much!! There has been nothing apart from a tail light out since then. He's lovely really this just makes him look bad!
