Can I earn money in UK AND a small amount in the USA?
« on: January 12, 2016, 04:03:12 PM »
Hi All,

I'm a dual national currently living in the UK.

I am self employed as a freelance photographer. In addition to my UK self assessment, I file my US tax return each year through an expat tax service.

This year I am spending the first few months in the USA with family.

I have booked a potential photography job here for $2,000 in April.

Obviously I have a US passport and Social Security Number, so my query is whether its ok to be resident in the UK, and earn a small amount of money in the USA while I'm here.

And if so, does it need to be reported in a different way? Ideally I would simply add it to the same return I normally do, as an extra $2,000 in income.

Thanks in advance for your help.

This issue was questioned in court way back in 1908, in a case known as Ogilvie v Kitton, which held that income from self-employment outside the UK whilst UK resident is UK taxable.

You will be able to claim the FEIE or foreign tax credits and exemption from US self-employment tax.
