Topic: Brit to marry in US...need birth certificate or will passport suffice?  (Read 1217 times)

If a person has a UK passport and comes to the US with intent of marrying an American who will apply for a spousal visa and move to the UK, what is needed for the Brit to show for identification when filing for civil marriage? I know here in the UK you don't need a birth certificate (atleast in Newcastle, don't know if it is different elsewhere) as a passport will suffice, but was wondering if it is the same in the US? Also, I know a person needs to be in the UK for a certain amount of time before filing intentions of marriage (and then needs to wait 17 days,) does anyone know what the time period is in the US? (I know you have to wait only 3 days from filing until actual marriage date.)

Which state are you planning on getting married in? As far as I know there are no residency requirements here but some states do have a waiting period between the application for the marriage license and when you are able to pick it up. The best thing to do is to check the requirements in the county that you plan to get married in. A passport should be enough but some places might want to see a birth certificate.

in CT, all we needed was his passport.

We got married in NC, and DH needed his passport and had to have a waiver notarised stating that he was a non-US citizen without a SSN.  I think that was all...and there was no waiting period.

Who wrote this waiver? Did you have it notarized in the US?
We got married in NC, and DH needed his passport and had to have a waiver notarised stating that he was a non-US citizen without a SSN. I think that was all...and there was no waiting period.

It was provided by the registrar of deeds.  It was very straightforward...the only problem was that we showed up really late on Thursday, hoping to get the license that afternoon.  We didn't know about the waiver, so we had to get it notarized on Thursday and go back to get the license on Friday (for Saturday's wedding!).   ::)  Good thing there was no waiting period!   ;D

Marriage laws are completely different from state to state, so it's best to just check the website.

Lola...I just read your about spousal visa experience on your website and was wondering: at what point did you contact NY for an appointment? Do you apply a few weeks before your partner is intending to arrive? I am hoping I won't have to do this...but we're still waiting for DF's passport to be sent back (he applied for permanent residency as everything is much easier with a British passport rather than his Hungarian one!)and only have a few more days for it to come before we will have to go to plan B, which is he comes to the US while I am at home visiting over Christmas. The twins and I are heading back the 15th of December.

The appointment system hadn't been set up when we applied, so we just  showed up.  I do know that you can make your appointment two weeks ahead of time.  I hope everything goes smoothly for you!   ;D
