FIXED PENALTY FOR SCHOOL ABSENCE
« on: October 14, 2016, 01:11:51 PM »
Hi,

I'm in the process of filling out an application for citizenship. In section 3 under the ' Good Character' part, their are questions about 'civil judgment or any civil penalty under the UK immigration acts'... I recieved a Fixed Penalty Notice for School Absence that my duaghert incuured because of a holiday we were on. I paid the penalty notice within the required 21 days from reciept of the notice.

My question is, do I need or should I disclose this under the 'Good Chracter' Section of part 3?  3.3 ' Do you have any civil judgements aainst you or any civil penalty under the UK Immigration Acats?' (I don't think that I do, but should I mention the Fixed Penalty Notice for School Absence, that I recieved and subsquentialy paid?

Any advice on this matter would be greatly appreciated.

Thanks in advance.

It looks like yes, you do need to disclose, but it shouldn't have a negative impact since you have paid it and no further action was required to resolve it.

From Section 3 of Guide AN ( newcomer link: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/529577/AN_Guide_-_June_2016.pdf [nonactive] ):

Quote
"SECTION 3: GOOD CHARACTER
3.1 – 3.2 You must give details of all criminal convictions both within and outside the
United Kingdom. These include road traffic offences. Fixed penalty notices (such as
speeding or parking tickets) must be disclosed, although will not normally be taken
into account unless:
• you have failed to pay and there were criminal proceedings as a result; or
• you have received numerous fixed penalty notices."
