Just got this response when I asked about the app asking for co-hab docs on another immigration board. Response is from an established/senior member that seems to be one of the primary advice giver/responders on that forum for years. And this response also matches up with what I was told by two different solicitors. So now I'm SO CONFUSED  ??? :o :\\\'(

"1. This is a common question asked regarding SET(LR) here. It has caused a lot of confusion so I blame the generic online document list that you get at the end of the application. That list incorrectly asks for the cohabitation documents which is NOT required at all under the long residence route as per immigration rules. Under the long residence route, you are applying based on your private life so you must apply on your own and qualify on your own. Your relationships, partner, any dependants, etc are therefore NOT relevant at all. You simply need all your passports and Life in the UK. As you are from the US then there is no English language requirement either."

I know it was awhile ago now, but the qualifying criteria hasn’t changed since I used SET(LR) way back in the dark ages of 2015: I didn’t need to prove that I met my Tier 2 general visa conditions. I suspect it would have been a different matter if my employer had reported to them that I no longer worked there. I guess the FLR (M) equivalent would be if your partner had reported the relationship had broken down (as they’re meant to when a relationship breaks down) and then you applied for SET (LR) after your curtailment period ended…

But your visa hasn’t been curtailed because your partner hasn’t reported a relationship breakdown because you’re still in a relationship!

I’d be applying the second you get back after Christmas. No point adding to your stress of ‘will I get the docs back in time’ etc… I think you’re cutting it a bit fine if you don’t already have an appt booked for like, yesterday. I know that’s two months away and two months can mean something in the infertility world, but it’s peace of mind know you can go on your trip.

Good luck.
