Please help fiance visa with one dependent
« on: November 03, 2016, 01:02:38 AM »
Hello, I am looking in to potentially applying to join my fiance and settle in the UK. I am a bit confused about what I am required to show that I have sole responsibility of my sons upbringing. The biological father has been absent since August of 2010, with no visitation or any kind of financial support. He is on the birth certificate so I am not sure what needs done to satisfy this on our application ? Thanks for any help.

Is there a custody agreement? A letter from him confirming this?

There is not a legal custody agreement, I never needed one in the past. I am sure he would sign whatever is required. I'm just not sure what he would need to sign. I have tried to get an address for him to serve custody papers to him. But the father is an illegal immigrant to the USA, so he is not very cooperative.

If you can get him to write a letter stating that you have sole responsibility and that he is happy for you to move your child to the UK, that should be enough.

Only if you cannot include not the original, signed letter.

Assuming he prints and signs it and then mails it to you, you just include the original letter and there's no need to certify/notarise.

Should I get it notarized ?

For your own comfort, I would personally have it notarized.  Just as a CYA.
