Hello! My husband and I are thinking of moving to the US soon. My spousal visa expires at the beginning of June. We were talking about renewing it, so I could stay at my job past June. But I have a few questions, and any answers would be appreciated! Especially if you have any links to official places that confirm it.

1. I know if my visa expires, I have to leave within 90 days, or risk deportation. If my visa expires and I leave the UK, would I be allowed back in on the visitor's 3 month stay, with the understanding it was just to move my things (I wouldn't be working, etc)? Is there a minimum amount of time required after your visa expires before you can reenter as a visitor?

2. If I do renew my visa, and stay a few months past when my original visa expires, would this hurt our application for a US spousal visa for my husband? As the expiration date would be at least 2 years from the time he'd hopefully be immigrating to the US...


I've been getting really bad anxiety diving into all this again... I can't believe I've had about 2 years of relief since getting my original visa approved!  :-\\\\

Aug 2013/14 - Marriage (legal & ceremony)
July 2014 - Applied for UK spousal visa
Oct 2014 - UK spousal visa approved
June 2017 - Visa expires

Not sure where you are getting your info from.

You need to l have left by the date of expiry if not renewing.  There isn't a grace period.

No minimum of time after leaving before you return, but the immigration officer will need to be satisfied that you are a visitor (life to return to in the US).

No issue at all with renewing and the visa having validity left.  Won't affect the US or U.K.

That's not true. You become an illegal overstayer the moment your visa expires. If you do not apply to renew the visa, you MUST leave before the expiry date on your visa, or you become an overstayer.

Visitors get up to 6 months' stay in the UK, not 3 months (don't know where you got 3 months from).

However, in order to be allowed back in after a short period away, you would have to show a lot of strong ties to the US to prove you were not intending to stay in the UK illegally without a new spousal visa.

No, it wouldn't be an issue.

So long as you are resident in the UK and your residency visa / permit is current and valid, you will be able to submit your I-130 via the US Embassy in London. The process is called Direct Consular Filing (DCF) and it is much, much faster than filing I-130s with the USCIS in the USA.

London no longer has a residency period requirement, so it doesn't matter how long you've been resident in the UK or how long your visa / permit has been valid. There's no guidance on how much validity you should have left at the time you submit your I-130 to London either. That said, the I-130 processing can take a few months so I'd personally advise you to have at least 3 months of validity left so you don't ever get caught out with an expired residency visa / permit while your I-130 is processing. After the I-130 is approved, your visa status in the UK no longer matters as far as the USCIS / Embassy is concerned.

London will want to see a copy of your current and valid residency visa / permit and additional proof of residency like utility bills, tax statements, rent or mortgage statements, etc. with your name on them.

If your visa expires in June, you have plenty of time left to submit your I-130 while resident on your current UK visa. Whether you should renew your UK visa really depends on WHEN you'd like to move to the USA. Do you have any ideas about that? I can help give you some ideas on timing your US visa applications and your UK renewal (if needed).
