3rd generation immigrant path to citizenship
« on: March 21, 2017, 02:45:51 PM »
My husband's grandmother is English so I understand he is eligible for the Ancestry visa. However, I know his father is eligible for British citizenship, so I'm curious if he were to apply for it and be approved, would my husband then be eligible to apply for citizenship too once his father holds it? Or is that only for children of natural born citizens?

Unfortunately, your husband wouldn't be able to qualify for UK citizenship unless either he or his father were born in the UK... because UK citizenship can only be passed down to one generation born abroad.

So, if his grandmother was born in the UK, she should be a UK citizen 'otherwise than by descent'.

Assuming your husband's father was NOT born in the UK, he qualifies for UK citizenship 'by descent'.

However, only people who are UK citizens 'otherwise than by descent' can pass down their citizenship to children born abroad, so while your husband's grandmother can pass his UK citizenship to her son, his father cannot pass his citizenship down to your husband.

Thank you, that's what I assumed but I wanted to check.

Is your husband a citizen of a Commonwealth country, or only a US citizen?
The Ancestry visa is only for those who hold citizenship of a Commonwealth country.

He's only a US citizen. I thought he was eligible since it was suggested to me years ago (but I'm 4th generation so it doesn't matter) but perhaps it's changed or the person who suggested it was mistaken on which countries it applied to. Either way he shuts me down every time I suggest moving there since we don't really know anyone, so it's just a hypothetical question in case he ever came around.

I believe the Ancestry route has always been for Commonwealth citizens only.

Looking at this Wiki article about it, there's no mention of it every being for anyone other than Commonwealth citizens. They've been talking about abolishing the route since 2005 (though it's still in tact for now):

While immigration between the UK and US are very very different animals, passing down citizenship is rather similar.

Since I moved to the UK, I've married and had a kid.  My daughter is a dual US/UK citizen as I'm a US citizen and her dad is a UK citizen.  However, if she never lives in the US to "qualify" handing down her US citizenship, the line stops with her.   :\\\'(
