Spouse Visa beginnings and an old arrest.

We will be getting married in August and plan to apply for mine and my son's Visas as soon as I sell my house in August. My fiancee and I are beginning to stress out about the application process. We are terrified that we will screw it up somehow and be denied. He meets the financial requirements no problem, but I have a minor arrest from 1994 when I was 18, for pot. I was on unsupervised probation for one year. I'm terrified this will get my application denied, even though I've not had so much as a parking ticket since then. (I was young and dumb) Does anyone know if this will cause me to get a denial? Also, any advise anyone can give on the process is greatly appreciated. It is incredibly overwhelming as I'm sure you all know. Thanks so much!

It won't be an issue at all.

The visa can only be refused due to the conviction if it happened in the last 12 months.

Since it was 23 years ago it will be considered spent and will have no effect on the visa decision... it may take a bit longer than normal to process but that will be it.

Just to add, you will of course have to declare it and it will help speed things up if you can include with your application any paperwork that you have which pertains to it.  :)

Thank you so much for the info. Unfortunately I don't have any paperwork in regards to this. Being so young I never even thought about hanging onto it. Oh hindsight. I did plan on declaring it and am a bit relieved that it won't cause an issue. Thanks so much!

Contact the courthouse in the county you were in.  You'll be able to get a copy.   :)
