Fiancee visa application questions....help please!!!
« on: July 09, 2017, 02:39:04 AM »
I have some questions about the visa application- I apologize if they are obvious and that there are so many! Thank you so much as always!!!

How long do you intend to stay in the UK?

-   Should I just put down the length of the visa (2.5 years)?

Personal details → Permanent address
How long have you lived at this address?

-   My parents do not live in the US anymore so I normally use my best friend’s parents’ house as my permanent address → which I have not lived in! I am currently renting a place in the US, should I just put that address down?

Have you been issued any visa for the UK, UK Overseas Territories, or Commonwealth Country in the last 10 years?
-   Answer is yes, because I had the Tier-4 General Student Visa. From my BRP I can tell when it expired but I can’t find out when it was issued, and by who! The visa page by UK Entry Clearance on my passport says: Place of Issue (Manila), Valid from 10/09/15, Valid until 10/10/15. Then there is a stamp from the immigration officer for 17/09/15. Thoughts?

Please enter details of up to your 5 most recent visits (to the UK)

-   Does this include travel outside the UK while I was on a UK visa? For example, I left the UK to visit the US → do I have to log when I came back to the UK in that trip, although I had a visa?

Have you been refused entry to the UK in the last 10 years (for example at a UK airport or seaport)?
Have you been refused a visa for any country including the UK in the last 10 years?

-   So I was initially denied a student visa the first time- which question would I answer based on this? The problem is that I don’t have the date of the refusal, only a rough estimate….is that okay?

So the other thing is that I teach online. Is it worth mentioning this job or is it easier to say that I am unemployed (a bit tricky to calculate total earnings as it asks in the application!)?

Have you ever received medical treatment in the UK?

- I noticed it asks when the treatment started and ended- does this include routine check ups (dentist appointments?)?

Will your sponsor be travelling with you to the UK?
-   This seems obvious but isn’t the answer no?

How are you exempt from the English langue requirement?
-   Do I just say I am a US citizen and have degrees at US schools?

I have some questions about the visa application- I apologize if they are obvious and that there are so many! Thank you so much as always!!!

Some answers in red. Hopefully one of the pros can help with the other bits.

How long do you intend to stay in the UK?

I'd put down however long you plan to stay.

Personal details → Permanent address
How long have you lived at this address?

-   My parents do not live in the US anymore so I normally use my best friend’s parents’ house as my permanent address → which I have not lived in! I am currently renting a place in the US, should I just put that address down?
I would suggest putting your  correct history down with your current correspondence address as your permanent address. If, however, you are going to move out soon then use a reliable address you can use in case the process takes longer than expected.

Have you been issued any visa for the UK, UK Overseas Territories, or Commonwealth Country in the last 10 years?
-   Answer is yes, because I had the Tier-4 General Student Visa. From my BRP I can tell when it expired but I can’t find out when it was issued, and by who! -   Does this include travel outside the UK while I was on a UK visa? For example, I left the UK to visit the US → do I have to log when I came back to the UK in that trip, although I had a visa?
I was told to include 10 years travel history, which I did

Have you been refused entry to the UK in the last 10 years (for example at a UK airport or seaport)?
Have you been refused a visa for any country including the UK in the last 10 years?

-   So I was initially denied a student visa the first time- which question would I answer based on this? The problem is that I don’t have the date of the refusal, only a rough estimate….is that okay?

I would forget routine stuff. Just major or ongoing problems.

Will your sponsor be travelling with you to the UK?
-   This seems obvious but isn’t the answer no?
if sponsor not travelling with you then no

How are you exempt from the English langue requirement?
-   Do I just say I am a US citizen and have degrees at US schools?
I am a US passport holder exempt from English language requirement

Fiancee visa application questions....help please!!!
« Reply #2 on: July 09, 2017, 06:42:18 AM »
1. I'd put that you will stay either permanently or indefinitely

2. What mbmoffat said

3. You put the 'valid from' date listed on the visa sticker in your passport... so 10/09/2015

4. No, I would say it means visits when you were living outside the UK. When you had the Tier 4 visa you were living in the UK and visiting a different country.

5. You put yes, you have been refused a visa. You will need to list the refused and include the paperwork you received when it was refusal. The date should be on your paperwork/refusal letter. If you no longer have it, then give an estimated date and in a cover letter explain that you no longer have the paperwork. It shouldn't be a problem but may delay processing of your application while they dig around to find your refusal details.

6. You must be completely honest about your employment - so if you teach online and are paid for it, then it would be a lie to say you are unemployed. And lying on a visa application can have serious consequences. For the earnings, can't you just give an estimate? It can't be considered for the application anyway, so a ballpark would be fine.

7. It includes any NHS treatment, so if you saw a dentist on the NHS I would put it down - they need to make sure you don't have any outstanding NHS charges... because if you have more than £500 in NHS debt, it's an automatic visa refusal. If you got the treatment during your Tier 4 visa, you should note this because you were entitled to NHS care and didn't have to pay extra.

8. Sometimes the sponsor will be visiting you in the US and will fly to the UK with you, or will be living in the US and moving with you. They need to make sure that you enter the UK either at the same time as your sponsor, or after your sponsor... you can't enter BEFORE your sponsor

9. your US citizenship makes you exempt

Thank you SO MUCH for your help!
I have a few follow-up questions.

5a. Have you been refused entry to the UK in the last 10 years (for example at a UK airport or seaport)?

5b.  Have you been refused a visa for any country including the UK in the last 10 years?

So which one of these questions would I answer? Because for 5a, I have not technically been refused entry at the airport, etc.....would I answer 5b?

As I've said, I do not have the refusal paperwork (it was 3 years ago and my guess is that I was angry/did not think I'd need it again!), but I do have an estimate of the time. Is it worth including my Tier-4 acceptance letter too?

For the cover letter to explain the refusal, can I say something like:
I applied for the Tier-4 (General) Student visa in July 2015.
I was refused this visa in August 2015. I misunderstood and did not submit the required financial documents.
Unfortunately, I do not have the official refusal letter.
However, I applied again and was issued a visa September 2015.

Yes. You answer the one that applies to you. If they both applied (i.e. you had both been refused entry at the border AND refused a visa by applying in advance) you would answer both.

Not necessary... you just give the details of the refusal (as best you can), i.e. visa applied for, when you applied/when it was refused, reason for refusal

If you have any reference numbers or anything like that, you can include them. If not, they'll just have to look them up for themselves.

Yes, something like that would be fine, although you could include a little more detail, such as, 'I applied for a Tier 4 General student visa in July 2015, to study for X degree at Y university'.

You will have been issued with a refusal letter originally, so it might be better to say 'I no longer have' it, rather than 'I do not have' it (which implies you didn't get one at all)

[For future reference, always keep all your paperwork from anything like this - as you will also have to list your refused visa and the details of it on future visa applications]

Ahh okay, thank you. Yes I know, I am beating myself up for it- I don't know why I don't have it! Aghhhhh.

Should I include this information in the "additional info section" on the online application, or will including a cover letter to explain this suffice?

This is a stupid question, but after I purchase shipping labels via VFS Global, I need to put all of my documents into my own envelope, right? All I do is slap the label on the envelope and drop it off at UPS? Thank you

Yes, that is correct, you'll be able to pick up an envelope at your UPS store.

Are you going to use priority processing? It's highly recommended to do so, due to the really long processing times at the moment.
If you do, make sure to buy the settlement type on the vfs website, write Settlement Priority Processing on the outside of the envelope in bold on all aspects and place your priority receipt on top of all the other documents in your package.

Thanks again for all your responses everyone! I appreciate it!

I am just looking at the Family details section and just so I'm not going crazy. Under the Spouse/Partner section the nationality, family name, given names DOB. That is all about my Financée not myself right? Even though further down the application there's a section called sponsor details that asks for this kind of information again?

Thanks again!!
