Missing Visa - Please Help

I am married to a UK national and I am from Malaysia, I have the ed Leave to Remain that needs to be upgraded in December of this year.

I went to visit my relations in late March and my new passport plus my old one with the paper visa was stolen from my hotel room. I applied and got a new Malay passport and my husband paid a solicitor to get help to get new UK printed spouse Visa.

The solicitor said that we have to re-apply due to it being non-bio type after he contacted home office to ask for advice.

I submitted my documents with the local translated police report on 15th May and had my biometric data taken the same day in Kuala Lumpur, I paid approx £650 for priority as advised by UKVI in Kuala Lumpur. The solicitor has received the POD from the carrier of the documents that was sent to Sheffield a few days after, but he has not received an eMail to say arrived.

He has wrote to UKVI 3 weeks ago asking for progress and they have not responded. My husband has phonedd the UKVI support number, paid the money and they just said it can take up to 60 days.

In June the police recover both my passports so I now have the visa back but my valid passport is in Sheffield. My solicitor said to wait for application to process but its taking so long.
 
I have now been out of the UK longer than is allowed due to lost passport

Can someone please advice can I cancel the application, of how to get progress updates, I paid for the SMS tracking but received only the initial one.

Thanks for your reply.

My solicitor was told by the homeoffice that that we had to apply for the Limited Leave to Remain again, but they would take my current months into account. They would transfer me into the Biometric visa rather than printed.

I though that a priority application would be completed by now.

I think you received incorrect advice.  You should have applied for a single entry visa into the U.K. and then applied for a biometric resident permit from inside the UK.   :-\\\\

I did wonder but my husband phoned the home office visa support line and the solicitor has sent me the email from the home office and both confirmed the re-apply route.

I was initially hoping to do a TOC or apply in the UK as I don't need a visit Visa as Malay is a Commonwealth country.

I worried since I apply mid May and no news.

Unfortunately the phone line nearly always gives incorrect advice.  Shame your solicitor didn't know better.

At this point I think you need to wait for UKVI to process your application.  Or you could try withdrawing your application but I anticipate that your old passport with the visa would now show up in the system as stolen.

Unfortunately it appears mist applications take up to 60 business days to process from Malaysia.

Thanks for your advice.

If I phone the the UKVI number will they be able to tell me the current status or tell me if they have loosed the application as priority?

I think it not logged and that is why it taken this long.

The call centre is useless and unable to tell you anything.
