Hi guys,

So I've been working on the Visa application for my wife. I'm in the US at the moment working as a self-employed contractor. As such the requirements for the self employment route (category F) are a little more complicated to fill out. Below are the requirements and how I'm addressing them. The final bit is what I'd like your advice on.

7. In respect of self-employment in the UK as a partner, as a sole trader or in a
franchise, all of the following must be provided:
(a) Evidence of the amount of tax payable, paid and unpaid for the last full financial year.
I will provide my 2016 tax return

(b) The following documents for the last full financial year, or for the last two such years
(where those documents show the necessary level of gross income as an average of
those two years):

(i) Annual self-assessment tax return to HMRC (a copy or print-out);
Tax return will cover this

(ii) Statement of Account (SA300 or SA302).
Tax return will cover this

(c) Proof of registration with HMRC as self-employed if available.
No registration required in the US

(d) Each partner's Unique Tax Reference Number (UTR) and/or the UTR of the
partnership or business.
Will provide US social security number

(e) Where the person holds or held a separate business bank account(s), bank
statements for the same 12-month period as the tax return(s).
Not applicable

(f) Personal bank statements for the same 12-month period as the tax return(s) showing
that the income from self-employment has been paid into an account in the name of the
person or in the name of the person and their partner jointly.
Will provide bank statements for the financial year

(g) Evidence of ongoing self-employment through evidence of payment of Class 2
National Insurance contributions, or (where the person has reached state pension age)
through alternative evidence (which may include, but is not confined to, evidence of
ongoing payment of business rates, business-related insurance premiums, employer
National Insurance contributions or franchise payments to the parent company).
Provide previous bank statements and invoices to show existing self-employment, as well as providing offer letter and contract for job upon arrival

Now this is where I get stuck!
(h) One of the following documents must also be submitted:
(i) (aa) If the business is required to produce annual audited accounts, such accounts for
the last full financial year; or
Not required to produce an audited accounts

(bb) If the business is not required to produce annual audited accounts, unaudited
accounts for the last full financial year and an accountant’s certificate of confirmation,
from an accountant who is a member of a UK Recognised Supervisory Body (as defined
in the Companies Act 2006) or who is a member of the Institute of Financial
Accountants;

Therefore I believe I need to provide this unaudited accounts. However, due to the nature of my work where I invoice monthly and receive payment as wages, I'm not registered as a company, nor manage accounts in that way. It seems like this is very much orientated towards those who operate an actual business.

Has anyone had any experience or advice on what to provide for this? My situation is a little more complicated since I'm an overseas sponsor moving back with my wife.

Do you use an accountant to prepare your tax returns?  Itemising your expenses and deductions along with your gross earnings?

Alternatively do you have the savings to use the cash savings route?  You can use 401k's and other retirement accounts.

Nope I prepared my taxes via HRBlock's online systems and no we can't take the savings route.

I've just heard back from a Chartered Accountants in the UK who will compile the unaudited account and letter for me if I provide him my US tax return + supporting material. So that's good news!

The whole thing is very frustrating though. I have to pay for financial documents to be drawn up when I wouldn't normally need them as a self employed sole trader. They're not cheap!

But I think the thing that bothers me the most is that I'm doing so much to prove my income for the last year when it really doesn't mean anything. I have a job offer for significantly more than the requirement which commences almost immediately upon arrival. That should hole more weight than what I've earned and spent in the last year.

Previous finances, unless they're in savings, mean nothing since that money is long since spent!

It doesn't make sense but most things with UKVI don't make sense.  The people are literally sitting there with a tick box list and you have to tick each box just so.

You could have a million pounds in debt and can't live above your overdraft but so long as you have recorded £18,600 as your intake, they are happy!
