Appendix 2 questions
« on: November 25, 2017, 02:56:10 AM »
Hello again everyone! I'm a little unclear as to what exactly a few of these questions are trying to ascertain and any guidance here would be amazing!

In part 1.28, "Is your sponsor financially responsible for supporting anyone financially, including children listed above?"

We just have 3 children together. They are all UKC. Does this want to know how much they cost us per month, or is it asking if there is any child support paid?

Also, just to double check, I don't fill out any of the pages for other financial categories, right? Seems obvious but also seems a lot to leave blank.

I have more questions, some for the online app. too, and I will post them as I go along but thanks so much in advance!

For 1.28, it’s asking how much you spend on supporting your children each month - so just give a ballpark figure of what you spend.

Ah ok, thanks! I filled it in that way initially and then second guessed it. I'm definitely finding some of the questions a bit frustrating.

Here is my last question (I hope) for Appendix 2. I thought I had a solid understanding of what financial category we are applying under (B) as my husband is currently working in the U.S. and has a job offer in the U.K.

My husband is in a construction union, he has been with his main company for a couple years but will go to other job sites sometimes when he's needed with another company (he's also been with this company for over 6 months). I've included pay slips for both companies so that no weeks are missing, though he meets the financial requirement with the main company alone.

Where I'm confused is 3.30 "Has your sponsor been in employment with the same employer earning the amount detailed in 3.29 above, continuously for 6 months prior to the date of application? (Category A)" The answer is yes. I thought we were only category A if he had been working in the U.K. for 6 months or more with the same employer?

Then for the next question, 3.31 "Has your sponsor had other salaried employment overseas in the 12 months prior to the date of application? (Category B)". I guess the answer here is also yes because it's 2 companies, though I could say no and explain in Part 5 what I explained above?

So basically I don't know what category we are applying under or how to answer this clearly. I hope my question itself makes sense and I'm so sorry for the lengthy post!

If your husband is currently living in the US and has a job offer in the UK, then the category you can apply under will depend on whether he is still employed in the US on the date you submit the online application.

If he is still employed by his US company on the date you submit the online application, you can apply under Category A:
- he is currently employed overseas and has been with his US company, earning at least £18,600, for at least 6 months (you can use both jobs for this)
AND
- he has a UK job offer lined up paying at least £18,600 and starting in the next 3 months.

If he has left his US job on the date you submit the online application, and is not currently employed (he is between the US job and the UK job), then you HAVE to apply under Category B, showing:
- he has earned at least £18,600 in total (before tax) in the US from any and all jobs in the last 12 months
AND
- he has a UK job offer lined up paying at least £18,600 and starting in the next 3 months.

So, on Appendix 2:

If he is employed in the US on the date you submit the online application

You tick Income from salaried employment overseas (with job offer in the UK) -> Category A

And you complete Part 3B as follows:
You tick 'YES' to 3.23:
You complete 3.24 to 3.30.
You tick 'Yes' to 3.30
You tick 'NO' to 3.31
You complete 3.39 to 3.48
End of financial requirement section.

If he has left his job in the US on the date you submit the online application

You tick Income from salaried employment overseas (with job offer in the UK) -> Category B

And you fill out Part 3B as follows:
You tick 'NO' to 3.23
You tick 'YES' to 3.31
You complete 3.32 to 3.48
End of financial requirement section.

Oh my goodness, I can't thank you enough for taking the time to explain this so well! I clearly had it a little mixed up and the situation is kind of odd as he's been off for a month but plans to return on Monday.

Under category A, would missing pay slips for a whole month pose a problem or could it just be explained in his sponsor letter? Also, besides only needing 6 months pay slips and bank statements rather than 12, and a letter from U.K. employer with job offer, will he need one from his current U.S. employer as well? Getting these letters has been a wee bit of a pain lol.

He MUST include all 6 months of payslips AND bank statements - if even one payslip or bank statement is missing the visa will be refused.

He will need:
- 6 full months of payslips showing at least £1,550 before tax on each one (if he is salaried)
- 6 full months of bank statements showing the deposit of every single payslip
- a letter from his current employer stating his employment details, current salary, length of employment, length of time earning current salary and type of employment
AND
- his new UK job offer letter

Or you can actually choose to apply under Category B anyway, even if he is still employed in the US, and send:
- 12 full months of payslips and bank statements showing total pre-tax earnings of £18,600
AND
- the UK job offer letter

In all, it might actually be easier just to stick to Category B.

To recap:
Currently employed in the US, with employer more than 6 months:
- you can choose Category A or B

Not employed in the US, or with employer less than 6 months:
- you can only use Category B

That is fantastic actually! I was fretting a little because he wanted to carry on working but it seemed it might be a bit more difficult now that we've already got everything together for Category B. Thanks again for putting me back on the right track (and so quickly too)! I truly appreciate your time  :)
