Hi

Please can one of the experts help me double check my ILR dates  and some further queries?

Funny how time flies as seems like only yesterday not a couple of years ago I was asking the same but for FLR!

My partner visa history is:

Visa issued effective 08 July 2013 expired 08th April 2016
Entered UK on 07th September 2013

FLR obtained and

BRP states issued 14th March 2016 expires 05th October 2018

We are going to do the in-person application and not postal.
 
So my understanding is:

5 years residence will be  07th September 2018

We can either

1 - Apply up to 28 days before 07th September i.e.from 10th August 2018 or
 
2 - Anytime up to the 5th October 2018

Of course we won’t apply on 4th or 5th October 2018 even doing it in person!

Second part of the question:

1 - Been reading up and keeping track of posts on here and in layman terms nothing has changed requirements wise than what we did for the FLR? Same financial requirement  (using my salary alone not savings etc)?

2 - Was a bit confused with the joint correspondence - is it since he arrived in 2013 or just since the FLR  was granted? I guess as we are applying in person we can just hand the whole lot in (I kept it all from the FLR appointment) but I know from this thread it can tick them off wading through un-necessary paperwork

3 - Once the ILR is granted he will get a new BRP and he shouldn’t travel until he gets it?  We were thinking of a short break around 18/08 so assuming  we got the FLR on say 11/08 he probably wont have the new BRP by then so maybe we should wait until after our break because it would still be over a month left to apply rather than traveling on the expired one (or do they keep it at the ILR appointment so he would have nothing?)

4 - He needs to do the life in the uk test - does anyone know what the waiting times to sit this are? Is it weeks like the driving test or quite quickly?

For the first part of your question, your dates are correct - you can apply up to 28 days before 7th Sept up to 5th Oct.

For the second part, yes the financial, accommodation and relationship requirements are the same.

You do need to pass the Life in the U.K. test though.

For the correspondence, I’m not sure - the FLR(M) is 2 years of correspondence but I think it may be 2.5 years for ILR as it doesn’t specify the 2 years, just ‘since last leave to remain’. A couple of people have applied recently so hopefully they can clarify.

For the third part, that’s correct - you need the BRP before travelling. If applying in person the BRP usually arrives within about 4 days but it can take 10 days.

For number 4 - not sure about waiting times but I don’t think it’s too long.

Your dates are correct.

Definitely wait until after your trip to apply.  He will hand over his BRP at the appointment (or send it with the application if you decide to send by post).

Financials are all the same (though less cash is needed if using cash savings).

Joint correspondence for the last two years.

Check on times for the LIUK test near you.  You DEFINITELY want to get that out of the way sooner rather than later.  It's unlikely to be more than a week or two to get in, but get that knocked out so that it's not a worry.  My closest test centre was an hour away (and I'm in the Southeast, not exactly rural).

And you do need to read the Life in the UK test book and take plenty of practice tests first. You can't just wing it!
