Question on criminal record
« on: February 01, 2018, 03:39:34 AM »
Hey there. I managed to dig up the records on a misdemeanor possession charge from 1994. I did disclose this info on my application, but when I dug it up I saw I was also charged with paraphernalia with intent to use, I had a pipe on me. (I was 18, it was New Years Eve, I had plans.) I did not include this on the application as I completely forgot it. It is listed under the same case file number but listed as charge two. The info online shows the case was decided on probation and was closed on 3/30/1995.  Is this going to screw up my chances of getting an approval? I didn't send the court docs in as I didn't think it was needed after 23 years. But now I'm second guessing myself and kicking myself. Any thoughts are, as always, greatly appreciated.

I think you will be fine. You have declared the charge, that’s the main thing, that indicates that you are not trying to conceal anything.  :)

You'll be fine.

You declared the charge, and since it happened more than 12 months ago, they cannot refuse the visa because of it anyway.

The only issue with not including the paperwork is that if they want to check the details, they may need to go searching for the records themselves instead of having them already on the desk in front of them... and all that would mean is that it might take a little bit longer to make the decision while they look up the information.

Southern Betty, where were you when I was 18?  We would have gotten on like a house on fire.
