Application closed?! New York office confusion...please help!
« on: February 01, 2018, 09:38:24 PM »
Priority Spousal Visa for US wife
Online application – Dec 15th
Biometrics – Dec 19th
Mailed – Dec 21st
UPS confirmation it was received – Dec 27th
Sheffield confirmation of receipt - Jan 9th
New York?! confirmation of receipt - Jan 10th
Sent Divorce decree having realised it’d been forgotten – Jan 15th
Call centre say case has been closed! - 1st Feb

Hi all.  We are in pieces, having been separated for over a month, now with no end in sight, and are hoping sharing our story might somehow help.  I’m from the UK and married my wife, a US citizen in December with the intention of moving back to the UK.  We sent with priority  and assumed that when we had no confirmation of receipt email that we would be ones to not receive it all, so were a little miffed that it came 2 weeks after UPS showed it was delivered.  Then we were really confused to receive another confirmation of receipt the following day, but from the New York office!  We just assumed it was an error of this ridiculous system and waited.

In the meantime I realised I’d not included my divorce decree from my first marriage so sent it in immediately with a cover letter and clearly referenced to the case number.

We have continued to wait and today my wife called the call centre help line to be told, to our horror, that our case was ‘closed’ on Jan 10th, the day we received this strange e-mail from the New York immigration office saying they had received our application.
A single day seems quick to send from Sheffield to New York, but really we have no idea what is going on.  Does anyone have any educated guesses?  We’ve been told, of course, that this has been escalated, but having to wait another 15 days just to hear where her passport and all our documents are, while the case is closed, is horrible.

I want to write to my MP but feel I need to wait to find out what has happened first from the call centre.  What do people think?  My other major concern is that the divorce decree is, or never has been, with the main documents.

Hi!
The call centre are notorious for giving incorrect information so I would take anything they say with a pinch of salt.
New York no longer has anything at all to do with settlement applications so it is likely that you received that email in error.
Did you clearly mark the outside of your package to indicate a priority application, as instructed?
How did you send the divorce certificate?

Thanks for your response!

I wrote Priority Application paid on both sides of the envelope in thick black pen.  I sent the divorce decree in first class (on reflection recorded would have been better), with the application reference number on the envelope and the cover letter.

We ignored the NY response because they are not processing settlements but it seems a strong co-incidence that the application was closed (if this is true) on the same day we got that e-mail.  And why two weeks for Sheffield to confirm after UPS delivery, it seems everyone was getting theirs within a day or two.

Thanks again!

The email from New York is strange but the delay in receiving the documents received email is not unusual.
I would also try to email Sheffield with the divorce certificate. It’s a required document, without which the visa may very well be refused.
You can try this address VISAINFO.SHEFO@fco.gov.uk

All applications that were sent over the Christmas period, were “acknowledged” on January 9.  So that’s perfectly normal

I think you got the NYC email by error and it’s nothing more than that.

Never call the call centre.

You could see if your MP can ascertain if the application is located in Sheffield.
