Questioning if we are Category A or B??

I have all the documents on hand and we're ready to mail our 2nd application to Sheffield tomorrow after my biometrics appointment. But now I am questioning myself whether we're using Category A or B?

My husband works for an international company and he basically just moved from their US office to their UK office (officially on paper). But really he works from home.

The US office is called "The XXX XXX Company, Inc." as stated on his payslips. Whereas the office in the UK is called "The XXX XXX Company (UK) Limited". Both companies share the same corporate website URL address.

So my husband started working in the US office on December 2013 and he transferred to the UK office in January 2018. The UK office gave him a new employment contract before his transfer, stating all the terms such as his new title, salary, benefits package, etc.

I prepared our documents as if we were applying under Category B. So we have his US payslips & corresponding bank statements since Feb 2017-Jan 2018. And his UK payslips & corresponding bank statements for Jan-Feb 2018. He only gets paid once a month, at the end of the month, so we don't have his March payslip & bank statement yet.

Am I overthinking this?  ???

Below are the documents we're submitting based on ksand24's checklist.

Applicant Documents
1. Receipt for Priority Processing
2. Return shipping label
3. Contents letter
4. Printed online Application form
5. Completed VAF4a Appendix 2
6. Biometrics confirmation (scheduled tomorrow)
7. IHS surcharge receipt
8. Current US passport
9. All previous passports
10. 1 passport photo

Sponsor Documents
1. Copy of UK passport photo page
2. Letter of support for the visa, outlining the following:
i) how you qualify to be a sponsor (British citizen)
ii) your employment details and which financial category you meet (Category B)
iii) your accommodation in the UK where you will live (rented flat)
iv) short history of the relationship

Financial Documents - Category B
**Period covered 16/02/2017 to 26/02/2018. My sponsor has not been paid for March**
1. 12 FULL months of original payslips showing at least £1,550 before tax on each one
- US payslips are accompanied by a letter from the employer confirming the authenticity
- UK payslip is original, mailed from company
2. 12 FULL months of bank statements showing the deposit of every single payslip.
- Both US & UK bank statements were stamped on every page, in branch
3. Letter from former US employer stating ALL of the following:
i) employment and salary
ii) length of employment - since December 2013
iii) length of time earning salary - since April 2017
iv) type of employment - permanent
4. Letter from current UK employer stating ALL of the following:
i) current employment and salary
ii) length of employment
iii) length of time earning current salary - since January 2018
iv) type of employment - permanent
5. Contract from current UK employer, gross annual salary exceeds minimum £18,600 needed

Accommodation Documents
1. Tenancy agreement
2. Letter from the landlord stating the number of rooms and his agreement for our family to live there
 
Proof of Relationship
1. Marriage certificate
2. Applicant's divorce decree
3. 2 photos - one early in our relationship and one during our civil wedding (only the 2 of us shown)
Evidence of living together:
4. Lease agreement (both our names)
5. Home renter's insurance (both our names)
6. IRS tax transcripts showing same addresses
7. Evidence of continued communication since January 2018:
- Screenshot of daily phone and video call log
- Screenshot of Gmail inbox showing email communication between sponsor & applicant
- Sponsor's flight itinerary for last visit to the US from 17/02-11/03/2018

If in doubt, go with Category B.

It may be that you could actually qualify under either A or B, but since he did move jobs in January, I think it would be safest to go with Category B, because:
a) you've already prepared for that category
and
b) you know you meet the requirements for category B

I wouldn't want you to apply under Category A and then have UKVI refuse the visa again because they decide that the UK job is actually with a different company and therefore he doesn't meet Category A because he hasn't been there 6 months yet.

Financial Documents - Category B

Just to note that the £1,550 per month does NOT apply to Category B. All you need to show is a current (new) salary of £18,600 or more AND the total of all 12 months of payslips is £18,600 or more.

You don't need a letter from his former employer, because he is no longer employed there and therefore the letter is irrelevant.

So, what you need for Category B is:

1) 12 months of payslips showing a TOTAL of £18,600 before tax
2) 12 months of bank statements showing the deposit of every payslip
3) letter from UK employer
4) UK job contract

Yes, the total of the 12 months of payslips exceed £18,600 before tax. I converted each US payslip to GBP using OANDA's historical exchange rate to be sure.

Yes, the bank statements show all the deposits of every payslip.

And yes, we have the letter & job contract from his current UK employer.

Didn’t think it was worth asking on a new post:

Going to print my passport photo page this weekend. Seen a few people mentioning getting it stamped at post office, is this needed at all? As I may not get a chance to do that now I am flying out to the states very soon

That's good :).

I just wanted to clarify that the specific amount of £1,550 every month only applies to Category A.

For Category B, you just have to show the total earned over 12 months... you could have been unemployed for some of those months, but you would still qualify as long as your total earnings were £18,600 or more in the other months.

It's not absolutely needed.

People have been fine sending a regular photocopy, but since the UKVI site says that if you don't have the original, you need a certified copy, we suggest getting the certification done if you can, just to be on the safe side.

No problem :). As long as you can see all the information on it, I don't think the size of the copy matters.
