Hi All,

My spouse visa was rejected few months ago saying that I did not meet the English language requirement since I am from English non speaking country and I was supposed to provide certificate issued by NARIC UK that states that my qualification is the equivalent to the standard of a Bachelor’s or Master’s degree or PhD in the UK, which was taught in English. By giving this reason, they rejected my visa.

So I went for appeal on this and finally I got a Withdrawal Letter from International Casework and Quality Assurance Team (ICQAT) saying that they are going to recommend decision center to overturn the refusal decision and grant Entry Clearance.

This is what the letter says:
Quote

I am writing to inform you that I have reviewed the decision made on 00/00/0000 to refuse your application. Pursuant to Tribunal Procedure Rule 17(2) I respectfully request that this appeal is treated as withdrawn.

This request for withdrawal is in order for a recommendation to be sent to the Decision Making Centre where your original application was decided to overturn the refusal decision and grant Entry Clearance.

The reasons for this are that the application was refused solely on the English language requirements of the United Kingdom Immigration Rules. In support of the application the appellant submitted a degree certificate issued by XXXX University  demonstrating that they graduated with a Master of Science in Software Engineering in 0000. They stated that the degree was taught in English. However, as the appellant is not a national of a majority English speaking country listed in paragraph GEN 1.6 they are required to provide a certificate issued by NARIC UK that states that their qualification is the equivalent to the standard of a Bachelor’s or Master’s degree or PhD in the UK, which was taught in English. This document has now been submitted with the grounds of appeal and shows that the level of English language for their degree is considered to meet the requirements of CEFR level C1.

If the withdrawal of the appeal is granted, we will advise the Decision Making Centre where your original application was decided. They will contact you in due course with further information about any next steps you need to take.

This letter is being copied to the Tribunal.

Yours sincerely,
International Casework and Quality Assurance Team (ICQAT)

Not sure if you have anyone come across this situation
My question:

What will be the next steps?
Are there any other review from tribunal or decision making center? Or can I start believe my spouse visa application is approved?
Do I get any other email/ letter to submit my passport? How long it may take to receive this letter/email?
After I submit my passport, how long they will take to return my passport with vignette card?

Kindly help.

Regards,
Nikki
