Just married in U.K. Spouse VISA questions.
« on: November 06, 2018, 07:15:53 PM »
Hello, everyone!

My partner and I have just entered into our Civil Partnership and are hoping to complete our spouse visa application by the end of this week.

Would anyone mind looking at our checklist and point out anything that is missing? We also have some questions regarding the correspondence portion of the application that I will ask under the checklist.

Checklist:
FLR (M) Form (do we fill this in online or on paper?) ((is this the correct form? Is there another application we need to fill out?))
2 passport sized photos of applicant
1 passport sized photo of sponsor
Email Confirming IHS payment
Receipt for in person priority appointment
Financial Requirement
12 months payslips
12 months bank statements (original; stamped)
Letter from department of education confirming salary and payslips are genuine
Letter from principal of school confirming (new) permanent teaching position
Employment Contract
Accommodation
Letter from sponsors mother stating that I have been living here
Photo copy of deed
Relationship
Original Civil Partnership Certificate
Photos of us
Correspondence (????)
Applicant
Letter from bank
Invoice from private hospital for treatment received
Health Insurance Bill
Broker bill and information
Phone bill
Sponsor and Applicant
Bank statement from joint account
Sponsor
Phone bill
Monthly letter sent from employer
Donor information letter from non-profit
Letter from university attended
Letter from bank confirming joint account

That’s all we have now?? Is this correct?? We are not sure what to do with the correspondence portion of the application since I have only lived here for 2 months and my partner doesn’t pay any bills at his mothers house.

Any critiques or advice would be so much appreciated!

Welcome to the forum and congratulations on your marriage :).

Looks like FLR(M) still has a paper form, which we have been recommending using over the online form, so the paper form is fine. In fact, if you have already booked an in-person appointment, you HAVE to use the paper form now anyway, as you cannot submit the online form without booking an appointment at the end of it.

Just going to rearrange your documents slightly to make sure you have everything:

Applicant Documents:
-  FLR (M) paper form
- Email Confirming IHS payment
- Receipt for in person priority appointment
- applicant's passport
- 2 passport sized photos of applicant with full name on the back

Sponsor Documents:
- sponsor's UK passport
- 1 passport sized photo of sponsor with full name on the back

Financial Documents
- 12 months payslips - salaried? non-salaried? Are total pre-tax earnings more than £18,600? Do they cover an entire 12 months and not a day less?
- 12 months bank statements (original; stamped) -  Do they cover an entire 12 months and not a day less? Do they show every payslip?
- Letter from department of education confirming salary and payslips are genuine
- Letter from principal of school confirming (new) permanent teaching position
- Employment Contract
- latest P60

Accommodation Documents
- Letter from sponsors mother stating that I have been living here. Also needs to state home is not overcrowded
- ORIGINAL Land Registry Document (can be downloaded from the Land Registry website for about £3)

Relationship Documents
- Original Civil Partnership Certificate
- you don't need any photos if applying in person as you will both be there in person

Correspondence
Up to 6 documents in each name, evenly spread over the time you have lived together, from at least 3 official sources
- can you list the exact dates on each one? Each applicant document should have a corresponding sponsor document from the same date/month
- if you cannot provide 6 each or don't have enough sources, you should write an explanation for why you don't have enough yet (i.e. the fact that you have only been here 2 months)

Thank you so much for the detailed reply.
Yes, my partner makes well over the required £18,600 minimum. We have every payslip from October of last year to October of this year. We also have all of the bank statements for this time period as well. My partner does not have his P60, will this be a problem? Should we work on getting this?

For the correspondence- I am thinking that we will not have enough for this section due to our circumstances at the moment. Is this common for people here on my visa?

Everything else we do have, minus the original land registry (which we will get!).

A couple of questions:
Which financial requirement category are you applying under?
What's his employment situation?
Is the new job contract with the same employer or a new employer?

The P60 is not mandatory, but the guidance says they might ask to see it. If you don't have it, no worries.

Yes, that's normal. If you don't have 6 documents each, just write a short letter explaining the reason why you don't have enough.

However, from your list, it looks like you DO actually have enough, as you have listed 6 in each name, so you may not need to write anything at all.

Please can you list each document you have, along with the date it was issued? That way, I can have a look and work out whether you meet the correspondence requirement or not.

Thank you again for all of your help!

I believe we will be applying under Category B. My partner was employed as a temporary teacher last academic year. He was paid a salary from September of last year until July of this year. The same school offered him a permanent position at the end of the academic year. Over the summer he picked up a second job so he could have income for the month of August (since his new contract didn’t start until September he didn’t have an income for August). Would this be the correct category to apply under?

For the correspondence here are the documents we are hoping to use:

My partner:
Letter from organization he donates to (October 1st)
Letter from the university he attended regarding donations and updates (October 1st)
Letter from bank (September 25th)
Joint bank account information and confirmation (November 1st)
Letter from employer about general things (October 1st)
Phone bill (October 4th)

Me:

Letter from bank (October 25th)
Letter from bank regarding joint account (November 2nd)
Invoice for treatment at private hospital (October 15th)
Letter from health insurance broker (October 8th)
Direct debit confirmation for health insurance (October 11th)
Policy confirmation from insurance company (October 16th)
Phone bill (November 4th)

Thank you SO much for all of your help!

Yes, it'll be Category B, since he only recently started the second job and had a gap in teaching employment in the summer.

Just wanted to check, just to make sure he didn't qualify under Category A.

Okay, for your correspondence, I would include all of it. While you do have enough documents each, I'm not sure if all of them will be considered acceptable official documents, so just in case, I would include a short explanation to say that this is all you have, due to only having recently arrived in the UK. As you are applying in person, you can always explain it to them yourselves.
