After fiancé visa
« on: January 15, 2019, 06:22:22 PM »
Hi guys!
I’m back in the UK and due to get married next month. Do I have to apply for the spouse visa next, or would it be flr? I just want to be 100% sure.

Also, my fiancé’s work has switched the payment system so that this months pay will be sent to him next month, which means this month will not have a paycheck. What do I do about that? We can meet the 6 month amount without it but I’m not sure if we HAVE to have six pay checks.

Otherwise I could possibly have his boss write a note stating this?

Thanks!

It will be FLR(M).

You must cover at least the full 6 months with both pay slips and bank statements, no getting around that.

When does your vignette expire?

When does your BRP expire?

They won't have a BRP, just the sticker.  But, same question... when does it expire?

Also, your sponsor's employment didn't change, right?  Still in the same job, making the same income?

Can't they just have the employer letter explain the change in pay system?  I assume the same wage will be paid, just delayed.

Edited: I misunderstood your post.

In the alternative, could they apply under category B, showing £18,600 in the last twelve months, and earning £18,600 going forward?

Expires in June.

But I can make the amount with 5 months. Would I be able to do this?

For example

Jan 3000. Feb 3000 March 3000 April 0 May 3000 June 3000.

The total is more than the 6 month needed amount, but there obviously wouldn’t be a pay check for the one month.

The total is more than the 6 month needed amount, but there obviously wouldn’t be a pay check for the one month.

The problem is that if his income is salaried, they calculate the amount that can count towards the financial requirement by taking the lowest payslip from the 6 months and multiplying it by 12.

So if he has one payslip with £0 on it, then the income that can count will be calculated as

£0 x 12 = £0
...which means a visa refusal.

Alternatively, if you simply don’t have a payslip from that month, then the visa can be refused because you did not provide a payslip from every single month (one month was missing).

But if you were able to apply under Category B, all you need to show is:
- the total earned in the last 12 months is at least £18,600 before tax (can be from any or all of the 12 months)
And
- his current annual salary is at least £18,600.

Therefore, if he is paid £3000 per month, you would only need 6 payslips from the last 12 months to meet the requirement... and it wouldn’t matter if you didn’t have a payslip for one month, because you could use the total of the payslips from all the other months.

Thank you! I’ll do the last 12 months.

I did have another question, Am I REQUIRED to be on the lease?( We are living with his father as of now who wrote a letter giving us permissions and the lease and such) and since we are moving it soon I don’t want to be put on it regardless. I’m adding myself to the bank accounts and phone bill but since we’re moving I don’t want to be added to the bills of the house. Any ideas?

No, there’s no requirement to be on the lease... but your father will need to provide an updated letter for the FLR(M) visa (if he hasn’t already) giving you permission to live there.
